RESOLUTION NO. 94-354
A RESOLUTION SETTING FORTH A SPECIFIC USE P1':RMIT ON A PORTION OF
PARCEL 5, FORT ROCK RANCHES, UNIT I-B, SECTIONS 7 AND 8, TOWNSHIP 20
NORTH, RANGE 11 WEST, FOR THE ESTABLISHMENT OF A WATER BOTTLING
FACILITY IN AN M (MANUFACTURING) ZONE IN THE MORAVE COUNTY GENERAL
AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held on October 4, 1994, a public hearing was conducted to
determine whether approval should be granted for a Specific Use Permit
for the above described property to Jeffrey Coombs of Lake Havasu
City, Arizona, and
WHEREAS, the property is located south of 1-40 approximately 30
miles east of Kingman. The site is accessed from 1-40 via the Knight
Creek interchange, then south along an unnamed road to Knight Creek
Road, then east to the site, and
WHEREAS, the surrounding land uses consist of mostly vacant land
with a few scattered homes. The area is primarily used for ranching,
and
WHEREAS, the three-pIus-acre site proposed for rezoning is part
of a 40-acre parcel. There is a home and dirt landing strip on the
40-acre parcel, with the three-acre parcel vacant, and
WHEREAS, the owner of the site proposes to use the site for a
water bottling facility. The facility will consist of a "clean room"
in which the water will be bottled and then shipped to Kingman for
further processing and shipping. The applicant has indicated that the
water must be bottled on-site and cannot be shipped in large
containers to another facility. This condition is part of the
requirements of the "Fair Packaging and Labeling Act" and is a part of
the water bottling regulations administered by the Food and Drug
Administration (FDA), and
WHEREAS, the water bottling facility was permitted on this site
by a Zoning Use Permit. The Zoning Use Permit was approved per BOS
Resolution No. 92-69. An Extension of Time was approved in 1993. The
applicant has requested another Extension of Time to move forward with
the project, and

WHEREAS, upon review of the Extension of Time, staff discovered
that bottling facilities are not permitted uses in A-R zones with
Zoning Use Permits, and
WHEREAS, staff has met with the owner and has indicated that the
use would be permitted in a manufacturing zone. The owner has
submitted application for M zoning and a Specific Use Permit to permit
the bottling facility on the site, and
WHEREAS, review of Floodplain Map #040058-2425B indicates this
parcel is located in Zone C, an area of minimal flooding, and
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning Commission on September 14, 1994, the Commission
recommended APPROVAL for a Specific Use Permit subject to the
following:
1. The applicant comply with all applicable provisions of the
MOhave County Zoning Regulations.
2. That the Specific Use Permit be for a water bottling
facility; any new use will require a Specific Use Permit.
3.
The bottling facility is to be located in an
building meeting the requirements of applicable
state and federal agencies.

5. If construction or use has not commenced within one year of

been discontinued for six months, then approval shall
terminate at that date.
6. This Specific Use Permit is subject to revocation upon 60
days notification by the Board of Supervisors if, in the
opinion of the Commission and Board, the continued use of
the property would be contrary to the public health, safety,
and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, September 18, 1994, and posted September 16, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Tuesday, October 4, 1994, APPROVED this
Specific Use Permit as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
