RESOLUTION NO. 94-344
A RESOLUTION SETTING. FORTH ACCEPTANCE OF ALL IMPROVEMENTS AND APPROVAL
OF THE AS-BUILT PLANS FOR WALNUT CREEK ESTATES UNIT 3, TRACT 3043-A,A
SUBDIVISION OF A PORTION OF SECTION 7, TOWNSHIP 20 NORTH, RANGE 17
WEST, LOCATED IN THE MCCONNICO PORTION OF THE MORAVE COUNTY GENERAL
AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held October 4, 1994, a public hearing was conducted to
determine the acceptance of all improvements and approval of as-built
plans for Walnut Creek Estates Unit 3, Tract 3043-A, and
WHEREAS, the owner/developer is Walnut Creek Development Company,
Mr. Dennis Sim of Kingman, Arizona. The engineer responsible for plan
preparation and the drainage study is Stovall Engineers, InC.,
Bullhead City, Arizona, and
WHEREAS, the Preliminary Plan depicts 211 acres subdivided into
160 residential lots. Minimum lot size is one acre. Average density
is 1.32 acres per lot. The project is to be developed in four phases.
Roadways and drainage parcels A through F will be dedicated to Mohave
County via Final Plat, and
WHEREAS, this phase consists of 60.8 acres subdivided into 43
single family residential lots and two parcels, and
WHEREAS, this property is located approximately one-half mile
southwest of the Interstate 40/McConnico Road exit, on the west side
of Oatman Road. The property is accessed through Walnut Creek Estates
Unit 2. The property to the north and west is owned by BLM, and
WHEREAS, water service will be provided by Walnut Creek Water
Company; electric and telephone will be supplied by Citizens Utilities
Company, The sewage disposal will be accommodated via individual
septic systems_ A variance from the requirements of the Uniform Fire
Code granted by the Arizona State Fire Marshal's Office allows fire
hydrant spacing of 1800 feet and fire flows of 500 gpm. This
subdivision is not within a fire district; however, Golden Valley Fire
Department has stated they will respond in emergencies, and
WHEREAS, the Preliminary Plan for this project was approved July
6, 1992, via BOS Resolution No. 92-236, and
WHEREAS, the Final Plat and all required documentation for Walnut
Creek Unit 3, Tract 3043-A, has been reviewed by staff. Acceptance of
the improvements and approval of the as-built plans will allow the
recordation of this phase of development, and

WHEREAS, at a public hearing on September 14, 1994, the Mohave
County Planning and Zoning Commission recommended acceptance of the
improvements and approval of the as-built plans based upon the
following:
The Mohave County Engineer, Harold J. Ganyo, P.E., in a
letter dated August 1, 1994, states: "All improvements have
been completed by the developer_ As-built plans,
certifications and required reports have been submitted.
The improvements have been inspected and substantially
conform to the plans, specifications, and County Standards."
Mr. Ganyo cites one exception as follows:
"Water lines from the main line to the individual lots have
not been installed. The Engineer of Record has submitted a
cost breakdown to show all of the costs associated with the
installation of the individual water hookups. The
franchised water utility, Walnut Creek Water Company, has
submitted letters of assurance, which were approved by the
County Attorney, stating that the individual lot hook-ups
will be installed upon each lot being developed, without
cost to the lot owner."
Mr. Ganyo's recommendations:
"Placement on the Planning and Zoning Commission Agenda for
review and recommendation for acceptance of all improvements
and approval of the as-built plans."
WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation, in Kingman, Mohave County,
Arizona on September 18, 1994, as required by the Arizona Revised
Statutes and the Mohave County zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Tuesday, October 4, 1994, accepted the
improvements and approved the as-built plans for Walnut Creek Estates
Unit 3, Tract 3043-A, as recommended by the Mohave County Planning and
Zoning Commission, subject to the conditions outlined herein.
