A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUnON NO 94-112
WHICH SET FORTH A REZONE OF THAT PORTION OF PARCEL 18 NORTH OF ARIZONA
STATE HIGHWAY 68, SECTION 7, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-R
(AGRICULTURAL-RESIDENTIAL) ZONE TO C-2H (GENERAL-COMMERCIAL/HIGHWAY
FRONTAGE) ZONE IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regu~ar meeting of the Mohave County Board of
Supervisors held on October 4, 1994, a public hearing was conducted to
determine whether approval should be granted for an amendment for a
Rezone on the above described property to Edward Bruce of Kingman,
Arizona, and
WHEREAS, lot size minimums were set for each property at the time
this property was Rezoned. After the property was surveyed it was
discovered that the parcels did not meet their lot size minimums.
This resolution is being amended to change the lot size minimums to
reflect the size of the parcels as indicated on the Parcel Plat. All
old language in the resolution is crtruolt and new language is bolded,
and
WHEREAS, the property is located six miles west of the Highway 68
and 93 intersection on the north side of Highway 68. The property has
frontage on Highway 68 and is accessed from Highway 68 via Colorado
Road, and
WHEREAS, the surrounding land uses consist of scattered homes and
vacant land, with the site proposed for rezone also vacant, and
WHEREAS, the owner is requesting C-2H zoning for the entire
parcel. The Planning and Zoning staff is recommending that the
southern 200 300 feet adjacent to Highway 68 be zoned C-2H and the
northern portion be zoned C-2. The owner's representative has been
notified of this change and concurs with staff's recommendation, and
WHEREAS, the owner proposes to divide the parcel into two one-
acre parcels and one six-pIus-acre parcel. The two northeastern one-
acre parcels are proposed for C-2/IA zoning. The other portion of the
property will remain as one parcel but will have two proposed zoning
designations, with the southern 200 300 feet proposed for C-2H and the
northwestern portion proposed for C-2 zoning, and
WHEREAS, review of Floodplain Map #040058-2325B indicates this
parcel is located in Zone C, an area of minimal flooding, and

WHEREAS, at the publio hearing before the Mohave
and Zoning Commission on September 14, 1994,
reoommended APPROVAL for an amendment of Resolution
to the following:

1. The northeastern parcels be zoned C-2/lA (General-
Commercial/One Aore Minimum Lot Size); the northwestern
paroel be zoned C 2/3.'\ C-2/2A (General-Commercial/'l'Mee Two
Acre Minimum Lot Size); and the southern 300 feet be zoned
C 211/2_", C-2H/4A (General-Commercial Highway Frontage/'l'we
Four Acre Minimum Lot Size).
2. Submi ttal and recordation of a Paroel Plat prepared in
acoordanoe wi th Artiole 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard
Speoifioations.
3. That the Board of Supervisors accept the dedioation of a
lOO-foot roadway along the south boundary, a 30-foot roadway
dedioation along the east and west boundaries, a 20-foot
roadway dedioation along the north boundary, and 20-foot
radius curves at each corner of the property, and the
granting of an 8-foot PUE around the perimeter of the
property. The dedioation and granting required by the
rezoning resolution shall be shown on the Parcel Plat and
accepted by the Board of Supervisors upon Paroel Plat
reoordation.
4. The parcels will meet or exceed their respeotive acreage

5. Each paroel shall have legal access.

9. If these conditions are not met within one year this
approval will be void. If at the expiration of this period
the property has not been improved to meet the use for which
it was conditionally approved, the Board (after notification
by registered mail to the owner and applicant who requested
the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for
development, or cause the property to revert to its former
zoning classification. This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-
832.
WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, September 18, 1994, and posted September 16, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Tuesday, October 4, 1994, APPROVED this
amendment as recommended by the Mohave County Planning and Zoning
Commission and outlined herein,
