PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 94-328 A RESOLUTION SETTING FORTH APPROVAL OF AN EXT~NSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF SUN DESERT ESTATES, TRACT 4121, BEING A SUBDIVISION OF THE s!..l, N\, NE\, SW\ AND THE Nl..i, SW\, NE\, SW\ OF SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held October 4, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Plan of Sun Desert Estates, Tract 4121, .and WHEREAS, the owner/developer of this tract is Phil Jost of Bullhead City, Arizona. The engineering firm responsible for the preparation of the overall plan and drainage study is Territorial Engineering, Incorporated of Bullhead City, Arizona, and WHEREAS, this subdivision is located approximately 2.5 miles south of Bullhead City's southernmost boundary and is approximately 1.25 miles east of Highway 95, and WHEREAS, the Preliminary Plan depicts 15 acres Subdivided into 49 single family residential lots. Lot sizes range from 8,800 square feet to 11,225 square feet, yielding a density of 3.2 units per acre, and WHEREAS, this property is bordered on the north by the proposed Moon Ridge subdivision; on the south by the proposed Pine River Estates and Moon Valley Subdivisions; on the west by Tierra Del Rio, Tract 4048-0; and on the east by unsubdivided properties and a portion of Moon Ridge. These projects are located on the western alluvial slope of the Black Mountains and are subject to flash flooding and sheet flow run-off. The Pine River Estates subdivision, Sun Desert Estates subdivision and the Moon Valley tract have been consolidated into one comprehensive drainage study, and WHEREAS, Company, Inc., and telephone septic systems water service will be provided by the Bermuda Water electric power provided by Mohave Electric Coop~Lo~ive, service by Citizens Utili ties. Individual on~si te will accommodate sewage disposal, and '-- . . RESOLUTION NO. 94-328 Page 2 PAGE 2 Of 2 8K 247~ PG 167 <fEE;94-'9177) WHEREAS, Article 3_10-1 states, " Upon appl~cation to the Comm~ss~on and pr~or to the expiration of the t~me limit, extensions ~n increments of one ( 1) year may be granted by the Board ~f the subd~v~der is act~ve1y processing the Final Plat. If such action is not taken, then all proceed~ngs relating to the plat shall be terminated.", and WHEREAS, in a letter dated July 28, 1994, Charles K. Dewald, P.E., representative of the developer, advised that the project improvement plans have been completed, reviewed and approved by County staff. The Final Plat has been approved by the Board of Supervisors. Outstanding items that need to be satisfied prior to recordation are ADEQ approval and the posting of assurances. DeWald further advised that economic conditions and ADEQ approval has slowed the development of th~s subdivision. Due to the high nitrate levelS in the valley, more extensive percolation test~ng is required and will be performed soon, and WHEREAS, the Prelim~nary Plan for this subd~vision was approved v~a BOS Resolution No. 91-65 on March 4, 1991. The Final Plat for this subd~vision was approved via BOS Resolution No. 92-54 on February 18, 1992, but has not been recorded. Th~s Extension of Time will serve as the first and second Extensions of Time, and WHEREAS, at a publiC hearing on September. 14, 1994, the Mohave County Planning and Zoning Comm~ssion recommended APPROVAL of the requested Extension of Time subject to the following: 1_ Compliance with all conditions as stated in BOS ReSOlution No. 91-65 and 92-54. 2_ This Extension of Time will be in effect until March 4, 1995. WHEREAS, the not~ce of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona on September 18, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations.
