RESOLUTION NO. 94-324 A RESOLUTION SETTING FORTH A ZONING USE PE~IT ON A PORTION OF THE SW!,;;, NW!,;;, SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FOR THE ESTABLISHMENT OF AN OFF-PREMISE SIGN IN A C-2H/4A (GENERAL COMMERCIAL HIGHWAY FRONTAGE/FOUR ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE ARIZONA STRIP AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1994, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to Terry Reid, In-Sight Advertising, Inc. of Salt Lake City, Utah, and WHEREAS, the land is located north of Interstate 15 along the 1- 15 Frontage Road. The property is accessed from 1-15 via the Farm Road interchange, then across the 1-15 Frontage Road to the site, and WHEREAS, the surrounding land uses consist of a few businesses along the south side of 1-15 and some scattered residential dwellings; the remainder of the area is vacant, and WHEREAS, the property was rezoned to highway commercial in December of 1993, per BOS Resolution No. 93-352. The site is vacant and no improvements have been made in connection with a commercial business, and WHEREAS, the proposed location meets the zoning and spacing requirements for an off-premise sign. The Arizona Department of Transportation (ADOT) requires the off-premise sign to be located wi thin 1000 feet of an established commercial business. This sign does not appear to be within 1000 feet of an established commercial business as defined by ADOT or the Mohave County Planning and Zoning Department. Before the sign is approved for construction, the Arizona Department of Transportation must issue a permit, and WHEREAS, since the site does not meet the criteria for an off- premise sign, ADOT will not issue a permit for this location. Staff feels that the Zoning Use Permit should not be approved at this time because the Department of Transportation will not issue an off-premise sign permit at this location, and WHEREAS, this item was heard before Commission at the August 10, 1994, meeting. the item to the September 14, 1994, meeting obtain an ADOT off-premise sign permit, and the Planning and Zoning The Commission continued to allow the applicant to ... _._ A- . . RESOLUTION NO. 94-324 Page 2 PAGE 2 Of 3 BK 2~7; PG 159 (FEE;94-S9174) WHEREAS, review of FloOdplain Map #040058-0025B indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, the Planning and Zoning Department staff originally recommended denial of the proposed ZUP based on the following: No off-premise sign permit will be issued by the Department of Transportation; without an ADOT permit, a building permit to construct the sign will not be issued by the Planning and Zoning Department. Since all necessary permits will not be obtained for the proposed sign, a Zoning Use Permit should not be granted. The roadway dedication, as required by BOS Resolution No. 93-352, has not been completed,and WHEREAS, the Planning and Zoning Commission did not follow staff's recommendation. The Commission placed conditions on the ZUP that addressed the required road dedication and state sign permit, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 14, 1994, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. An ADOT off-premise sign permit will be required prior to issuance of a County building permit for the sign. 2. The roadway dedication required by BOS Resolution No. 93-352 must be recorded prior to issuance of a County building permit for the sign. 3. That appropriate zoning, building, floodplain permits be obtained. environmental 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 18, 1994, and posted September 16, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. and RESOLUTION NO. 94-324 Page 3 -' -. - ~ . . PAGE 3 OF 3 6K 2+1+ r6 160 (FEE~94+~917+) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, October 4, 1994, APPROVED this zoning Use Permit as recommended by the Mohave County Planning and Zoning CommisSion and outlined herein.
