A RESOLUTION SETTING FORTH APPROVAL OF THE AS-BUILT IMfROVEMENT
pLANS AND RELEASE OF ALL REMA];NING FINANCIAL ASSURANCES FOR
WALNUT CREEK ESTATES UNIT 2, TRACT 3013, A PORTION OF SECTION 7,
TOWNSHIP 20 NORTH, RANGE 17 WEST, LOCATED IN THE NORTH KINGMAN
AREA, MOHAVE COUNTY, ARIZONA,
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held September 6, 1994, a public hearing was
conducted to determine whether approval should be granted for the
As-built Improvement Plans and the release of all remaining
financial assurances for Walnut Creek Estates Unit 2, Tract 3013,
and
WHEREAS, the owner/subdivider of this tract is First
American Title Insurance of Mohave, Walnut Creek Development Co.,
c/o Dennis J. Sim, Kingman, Arizona. The engineer of record on
this project is Stovall Engineers, Inc., Bullhead City, Arizona,
and
WHEREAS, the subdivision is located
the Interstate 40/McConnico interchange
Oatman Road, and
one-half mile south of
on the west side of
WHEREAS, this subdivision consists of approximately 184
acres subdivided into 109 single family reSidential lots and 15
parcels, some of which will be developed at a later date. All
residential lots exceed one acre in size, and
WHEREAS, electriCity and telephone service are provided by
Citizens Utilities Company, water is provided by the Walnut Creek
Water Company, and sewage disposal is accommodated via on-site
septic systems, and
WHEREAS, the Mohave County Engineer, Harold J. Ganyo, P.E.,
in a letter dated June 15, 1994, states: "All improvements have
been completed by the developer. As-built plans, certifications
and required reports have been submitted. The improvements have
been inspected and substantially conform to the plans,
specifications, and County. Standards. "

"The Water Construction Plans lack as-built certification.
The Engineer of Record has certified to the installation of
the water works in accordance with the Improvement Plans and
specifications to the Arizona Department of Environmental
Quality and a Certificate to Operate has been issued. The
Arizona Department of Environmental Quality did not require
As-buil t Plans at that time and the Engineer of Record is
deceased. To require As-built Plans to be obtained, sealed
and SUbmitted by an engineer at this time would require
excavating and exposing the installed water system in order
to field verify its exact location. This would be
impractical and I believe not necessary because of the
previous certification to the Arizona Department of
Environmental Quality."
Mr. Ganyo's recommendations:
"Placement on the Planning and Zoning Commission Agenda for
review and recommendation for acceptance of all improvements
and approval of the As-Built Plans and the release of all
remaining Financial Assurances", and
WHEREAS. at a public hearing on August 10, 1994, the Mohave
County Planning and Zoning Commission recommended APPROVAL of the
Apprroval of the As-built Improvement Plans and release of all
remaining financial assurances.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation, in Kingman,
Mohave County, Arizona on August 21, 1994, as required by the
Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 6, 1994, APPROVED
the As-built Improvement Plans and release of all remaining
financial assurances for Walnut Creek Estates unit 2, Tract 3013,
as recommended by the Mohave County Planning and Zoning
Commission, subject to the conditions outlined herein.
