PAGE i OF 2 HOHAUE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 Nt R~SOLUTION NO. 94-310 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF SECTION 8 (EXCEPTING THE ATCHISON, TOPEKA AND SANTA FE RAILWAY RIGHT-OF-WAY AND STATION GROUNDS) AND A PORTION OF SECTIONS 5 AND 17, TOWNSHIP 16 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO M-X (HEAVY MANUFACTURING) IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for a rezone for the above described property to Franconia Technologies of Phoenix, Arizona, and WHEREAS, the property is located east of Highway 95 and north of 1-40, and WHEREAS, the original rezone request for this site was approved in January of 1990. Extensions of Time have been granted on a yearly basis since the rezone was approved, and WHEREAS, this item was continued by the Planning and Zoning Commission at their meeting of April 13, 1994. The Commission felt that further information was needed to ensure that Franconia Technologies' intentions for the site remain consistent with the original conditions of approval for the rezone. The Extension of Time was also discussed at the July, 1994, P&Z meeting and the Commission continued the i tern as requested by Franconia Technologies, and WHEREAS, Franconia Technologies has submitted a letter listing the events detailing the development of the project. The letter indicates that significant progress has been made toward the development of the project and requests the granting of a one year Extension of Time, and WHEREAS, Gammage & Burnham, Attorneys at Law representing Franconia Technologies, submitted a letter dated July 13, 1994, indicating that Franconina Technologies has not requested modifications of any conditions or stipulations imposed by Resolution 90-15, and it continues to be Franconia Technologies' intent to comply with each and everyone of the stipulations imposed by that zoning approval, and RESOLUTION NO. 94-310 Page :2 .. PAGE 2 OF 2 BK 2478 PG ba3 (FEE~94-61495) WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 10, 1994, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Continued compliance with conditions of BOS Resolution Nos. 90-15, 90-289, 91-30, 91-315, 92-35, and 92-398. 2. This Extension of Time will be in effect until January 22, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, MOhave County, Arizona, September 18, 1994, and posted September 16, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, October 4, 1994, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein. BE IT FURTHER RESOLVED, that the Board of Supervisors added Condition No. 3 as follows: 3. The following items are to be submitted with the next Extension of Time: a. A copy of the sections of the Private Agreement between Franconia Technologies, A Waste Management Company and the AT&SF Railroad that pertain to the crossing of the railroad's tracks, to the dedication of that crossing to Mohave County, and to any items that reference BOS Resolution No. 90- 15 or are intended to meet any conditions contained in that Resolution. b. Copies of any responses received from the Arizona Corporation Commission, the Mohave County Public Works Department and the AT&SF Railroad concerning the design of the elevated roadway.
