MOUNTAIN VISTA RANCHES, SECTIONS 26 AND 27, TOWNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO A-R/7A (AGRICULTURAL-RESIDENTIAL/SEVEN ACRE MINIMUM LOT SIZE) LOCATED IN THE MORAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meet~ng of the Mohave County Board of Superv~sors held on September 6, 1994, a public hear~ng was conducted to determ~ne whether approval should be granted for a rezone for the above described property to Russell and Teresa McCoy of Kingman, Arizona, and WHEREAS, the property is located west of Antares Road and south of Painted Rock Drive. This land is accessed via Hwy. 66, then west on Concho Drive, then north on Painted Rock Drive to the site, and WHEREAS, the s~te is flat and vacant with no development ~n the vic~n~ty except bladed roadways, and WHEREAS, there is minor drainage on the southwest Side of the parcel and a Shallow dra~nage wash that runs parallel w~ th the entire western boundary of the parcel, and WHEREAS, the owner ~ntends to diVide the property ~nto five separate seven-acre parcels. This is in conformance with ARS Sections 32-2101 and 11-0809 which became effective July 17, 1994, and WHEREAS, review of FEMA Floodpla~n Map Nos. 040058-2000B and 040058-2025B ~ndicate that the parcel is w~th~n Zone C, an area of m~nimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Comm~ssion on August 10, 1994, the Comm~ssion recommended APPROVAL for a rezone subject to the following: 1. The parcels be zoned A-R/7A (Agricultural-Res~dent~al/ Seven Acre Minimum Lot Sizes). 2. Submittal and recordation of a parcel plat prepared in accordance w~th Article 3.16 of the Mohave County Subd~ vision Regulations, and 102. 04-B of the Standard Specif~cat~ons. , -- . . . That the Board of Supervisors accepts the dedication of a 42-foot roadway easement along the southern boundary of Parcel 27-16 and a 3D-foot radius curve at the intersection of the proposed dedication. In addition, the granting of an 8-foot PUB along the south side of the parcel. The dedication and granting required by the rezone resolution shall be shown on the parcel plat and accepted by the Board of Supervisors upon parcel plat recordation. 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. 6. The parcel plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These penni ts will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met wi thin one year this approval will expire. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification, ThiS action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 21, 1994, and posted August 22, 1994, as required by Arizona Revised Statutes and the MOhave County Zoning Regulations,' .. . . RESOLUTION NO. 94-308 Page 3 PAGE 3 Of 3 BK 2461?G 33 (fEE~94-~3555) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 6, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
