PAGE i OF 2 HOHAVE COUNTY BOARD OF SUPERVISORS RECORD!NG fEE 0.00 Mt RESOLUTION NO. 95-40 A RESOLUTION SETTING FORTH A REZONE OF LOT 2, BLOCK 3, MOUNTAIN VIEW RANCHES, TRACT 4003-B, SECTION 5, TOWNSHIP 18 NORTH, RANGE 21 WEST, FROM A- R/5A (AGRlCUL11JRAL.RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE TO A-R/2A (AGRlCULTURAL-RESIDENTIALffWO ACRE MINIMUM LOT SIZE) ZONE IN THE SOUTH MORA VE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 6, 1995, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to Greg Fritz of Fort Mohave, Arizona, and WHEREAS, the property is located north of Boundary Cone Road and east of Bradley Drive, This land is accessed via Highway 95, then east on Boundary Cone Road, then north on Bradley Drive to the site, and WHEREAS, the site is vacant and mostly flat to slightly rolling. There are no residences in the area. The owner proposes to split the five acres into two parcels each containing two-plus acres, and WHEREAS, there are some minor drainage areas and washes on the property. Review ofFEMA FIRM Panel #040058-2445C indicates that this parcel lies within Zone A, FEMA Special Flood Hazard Area. A Floodplain Use Permit is required for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 11, 1995, the Commission recommended APPROVAL for a rezone subject to the following: 1. The parcels be zoned A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size). 2. Submittal and recordation ofa parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and I02.04-B of the Standard Specifications. 3. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 4. Each parcel shall have legal access. 5. The parcel plat shall show any surface drainage and FEMA flood zones, . These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 22, 1995 and posted on January 20, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on February 6, 1995, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
