A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE N 1/2,
SW 1/4, NW 1/4 OF SECTION 19, TOWNSHIP 21 NORTH, RANGE 20 WEST, FROM A-R/I0A
(AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO M
(MANUFACTURING) ZONE IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
6, 1995, a public hearing wa, conducted to determine whether approval should be granted for an Extension
of Time for the above described property to owner Janet Daniell of Bullhead City, Arizona, and
WHEREAS, the property is located two miles northeast of the Bullhead City limits and north of
Highway 68 and is accessed from Highway 68 by Katherine Mine Road, which is an undocumented
roadway. The land uses in the area consist of a single family residence to the south with the remainder of
the area vacant. There is Bureau of Land Management (BLM) land to the north and east, state land to the
west, and private land to the south. The BLM has indicated that this site is located within a Desert Tortoise
habitat, and
WHEREAS, review ofFEMA FIRM Panel #040058-2280C indicates this parcel is located in Zone
C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and
WHEREAS, the applicant is requesting M (Manufacturing) zoning to use the site for liquid waste
evaporation ponds. The applicant owns a septic tank pumping service and will transport the sewage to the
site and empty the contents into the ponds; the solids remaining after evaporation will be used for fertilizer,
and
WHEREAS, the topography of the area consists of a variety of washes which have channeled
through the terrain creating small steep hills. This rugged terrain limits the possible locations for the
proposed evaporation ponds and may require extensive grading, and
WHEREAS, an engineering firm has been contracted by the applicant to perform the necessary
criteria in creating the evaporation ponds and will work with the Arizona Department of Environmental
Quality (ADEQ), and

WHEREAS, this zone change was conditionally approved by the Mohave County Board of
Supervisors on March 1, 1994 per BOS Resolution No. 94-70. On December 14, 1994 the Mohave
County Planning and Zoning Commission recommended approval of the Specific Use Permit for the
establishment of the liquid waste evaporation ponds. On January 3, 1995 the Board of Supervisors approved
the Specific Use Permit via BOS Resolution No. 95-10, and
WHEREAS, the applicant requested in her letter dated November 28, 1994, that the rezoning be
extended for one year. The letter states, "We have the easement currently in escrow. We have been in
contact with the Bureau of Land Management (BLM) for that portion of the roadway needed from BLM
and have applied for it through our attorney. All aerials have been done, all engineering completed. The
major holdup will be the review time and approval from ADEQ," and
WHEREAS, this will be the first Extension of Time for this property, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 11, 1995, the Commission recommended APPROVAL for an Extension of Time for a rezone
subject to the following:
1. Continued compliance with the conditions ofBOS Resolution No. 94-70.
2. This Extension of Time will be in effect until March 1, 1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, January 22, 1995, and posted January 20, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 6,1995, APPROVED this Extension of Time for a rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
