PAGE 1 OF 2 MOHAVE COUHTY 80ARD OF SUPERVISORS RECORDING FEE 0.00 He " RESOLUTION NO. 95-31 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF PARCEL E, SUNLAKE VILLAGE, TRACT 3700, SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FOR THE ESTABLISHMENT OF A TEMPORARY WASTE WATER DISPOSAL VAULT IN A C-RE/36A (COMMERCIAL-RECREATIONrrHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 6, 1995, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to Scott F. Ward ofFTF Investments, Tempe, Arizona. :Mr. Ward is requesting this Zoning Use Permit for a temporary waste water disposal vault to be used for Sunlake Village, Tract 3700, and WHEREAS, Parcel E is designated to be a park site when this subdivision is completed. It will be temporarily used as a waste water disposal vault and the waste will be pumped and hauled to a proper disposal site. Once the permanent waste water treatment plant on Lot 55 is approved by the Arizona Department of Environnlental Quality (ADEQ), the operation of the vault and haul on this parcel will cease and this parcel will revert to the planned park, and WHEREAS, the property is located adjacent to the Lake Havasu City limits, northwest of the city and west of Highway 95 and is accessed from Highway 95, then west on Lake Drive to Kenneth Lane, then south on Kenneth Lane to Diane Drive, then east on the extension of Diane Drive to the site. The site is located approximately in the middle of the proposed Sunlake Village Subdivision. There are no paved streets in place at this time, but the site has been graded, and WHEREAS, the surrounding land uses to the proposed site consists of a mobile home park to the north and west, and a mini-storage also on the north side. Lake Havasu City limits is on the south boundary of this project. Highway 95 makes up the eastern edge, and WHEREAS, review ofFEMA FIRM Panel #040058-31 lOB indicates this parcel to be in Zone AO, in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is required for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 11, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: .. Under no circumstances win this vault and haul operation exceed 18 months from the date of Board of Supervisors approval. 2. The applicant comply with an applicable provisions of the Mohave County Zoning Regulations. 3. Final Plat approval for Sunlake Village, Tract 3700, will include the subject parcel. 4. That the appropriate zoning, building, environmental and floodplain permits be obtained prior to construction. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 22,1995, and posted January 20,1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 6, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
