RESOLUTION NO. 95-28 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF TAX PARCEL #402-32-080 AS SHOWN ON MOHA VE COUNTY ASSESSOR'S MAP DATED NOVEMBER 23, 1994, LOCATED IN THE NW 1/4 OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FOR A BEAUTY SALON, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 6, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Cheryl Jenkins and Richard Cooper of Littlefield, Arizona. The area being rezoned is the southwest 110 feet of Tax Parcel #402-32-080, shown on Mohave County Assessor's map dated November 23, 1994, and WHEREAS, the property is located north ofInterstate 15 and east of the I-15 Farm Road Exit in the Littlefield area. It is accessed from the 1-15 Farm Road Exit, then north on the Frontage Road approximately one-eight mile to an ingress/egress public utility easement running to the northwest. The site is located on the southeast side of this I&E PUE and does not appear to have legal access, and WHEREAS, the property is in a primarily residential area. The surrounding land uses include several homes. This parcel shares a common property line with Parcel 68, a parcel that is zoned C-2H. Because this is primarily a residential area, staff believes that the zoning should be C-l (Neighborhood Commercial) instead of C-2 (General Commercial). Beauty shops are allowed in both zones, and WHEREAS, review ofFEMA FIRM Panel #040058-0025B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 11, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The property win be zO.El<>t~:1. (Neighborhood Commercial), a zoning that is more in line with the other residential uses in the surrounding area. 2. The Public Works Department requires that an Ingress/Egress and Public Utility Easement (I&E, PUE) be created to serve this parcel. A Parcel Plat in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of Standard Specifications be submitted and recorded depicting the division ofthese parcels. ~. , . . The applicant comply with all applicable provisions of the Mohave County Zoning Regulations for commercial establishments and Section 27.P (Site Plan Requirements). 5. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and the applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to it former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 22, 1995, and posted January 20, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 6, 1995, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
