SECTION 27.F.3, SETTING FORTH A CHANGE TO ALLOW SWIMMING POOLS IN THE REQUIRED REAR YARD SETBACKS, BUT NO CLOSER THAN FIVE FEET TO THE REAR PROPERTY LINE. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for an Amendment to the Mohave County Zoning Ordinance, Section 27.F.3, setting forth a change to allow swimming pools in the required rear yard setbacks, and WHEREAS, the Mohave County Planning and Zoning Department is requesting this change to the Mohave County Zoning Ordinance based on the six requests to the Board of Adjustments seeking variance from the current zoning requirement which disailows placement of these structures in the rear yard setbacks, and WHEREAS, this department has received about six additional requests for variance procedures and have asked that the applicants hold off until the department tries to amend the ordinance, and WHEREAS, staff evaluation of this amendment shows it to be a necessary change due to the number of requests for variances. It will bring the ordinance more in line with the ordinances of the neighboring cities and counties which have this provision in their ordinances, and it complies with the Uniform Building Code. This amendment will not weaken the specific objectives of the zoning ordinance with respect to setback requirements, and WHEREAS, language to be added has been bolded; language to be deleted has been stn:It:k: Section 27 GENERAL PROVISIONS (continued) F. RESOLUTION NO. 95-22 Page 2 PAGE 2 OF 2 BK 2510 PG 475 {FEE~95- 336) WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL of the Amendment to Mohave County Zoning Ordinance, Section 27.F.3 to the Board of Supervisors. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 18,1994, and posted December 19, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 3, 1995, APPROVED this Amendment to Mohave County Zoning Ordinance, Section 27.F.3 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
