RESOLUTION NO. 95-18 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 183, AS SHOWN IN RECORD OF SURVEY BOOK 1, PAGE 78, SECTION 28, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM A.R/I0A (AGRICULTURAL.RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO A. R/5A (AGRICULTURAL.RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to James and Mary Ellen Teeter of San Diego, California, and WHEREAS, the property is located east of A venida Obregon and north of Calle Alamo. This land is accessed via Stockton Hill Road, then east on Jane Avenue, then south on Cherum Road, then east on Calle Alamo, then north on A venida Palma to the site, and WHEREAS, the site is vacant and mostly flat. There are a few scattered residences to the west of the site. The owner intends to split the property into three five-acre parcels and two ten-acre parcels, and WHEREAS, there are some washes and drainage on the property. Review of Floodplain Map #040058-2l55B indicates that this parcel lies within Zone A, an area of lOO-year flood, base flood elevations and hazard factors not determined, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for a Rezone subject to the following: I. The three eastern parcels be zoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size) and the two western parcels be zoned A-R/IOA (Agricultural-Residentialffen Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accepts the dedication of a 45-foot roadway on the western and northern boundary of the parcel, and a 50-foot interior cul-de-sac complete with a 50- foot radius bulb. The dedicated roadway shall be named A venida Palma Bay. In addition, the Board accepts 20-foot radius curves at all dedicated roadway intersection points and at appropriate cul-de-sac points. .... . . RESOLUTION NO. 95-18 Page 2 PAGE 2 OF 2 BK 2510 PG 463 (FEE~9S- 383) 4. That the Board of Supervisors accepts the granting of an 8-foot PUB adjacent to roadways. 5. The dedication and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The Rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 11. If these conditions are not met within one year, this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 18, 1994, and posted on December 19, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
