PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ht RESOLUTION NO. 95-17 A RESOLUTION SETTING FORTH A REZONE OFA PORTION OF THE E 1/2 OF PARCEL 2, STOCKTON HILL RANCHES, UNIT XII, SECTION 5, TOWNSHIP 23 NORTH, RANGE 16 WEST FROM A-R/I0A (AGRICULTURAL-RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICUL TURAL-RESIDENTIAUFIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Dennis and Georgia Vanderheiden of Escondido, California, and WHEREAS, the property is located north of Yeater Road and west on A venida Obregon. This land is accessed via Stockton Hill Road, then east on Calle Lucaro, then north on Dubois Drive to the site, and WHEREAS, there are no residences or development in the vicinity of the property. The created parcels conform to the Long Mountain Area Plan, and WHEREAS, the property consists of more than 15 acres, is vacant and primarily flat. No significant drainage or washes cross the property. Review of Floodplain Map #040058-2000B indicates that this parcel lies within Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for a Rezone subject to the following: I. The parcels be zoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accepts the dedication of the 30-foot roadway on the eastern boundary of the property. In addition, the Board accepts 20-foot radius curves at all dedicated roadway intersection points around the property. 4. That the Board of Supervisors accepts the granting of an 8-foot PUE along the northern, eastern and southern boundaries of the property. 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. ~ . . ( 1 ... RESOLUTION NO. 95-17 PAGE: 2 OF 2 ilK 2~ 10 PG ~66 (FEE~95- P!J81)2 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The Rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If these conditions are not met within one year, this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December IS, 1994, and posted on December 19, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
