PAGE 1 Of 3 ..)j: MOHAVE COllHTY BOARD OF SUPERVISORS . ,,?:,, Rr.COROIKii FEE 0.00 He: \' RESOLUTION NO. 95-16 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 37, PEACOCK MOUNTAIN RANCHES, SECTION 7, TOWNSHIP 21 NORTH, RANGE 15 WEST FROM A-R/I0A (AGRICULTURAL.RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/4A (AGRICULTURAL-RESIDENTIALlFOUR ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Miriam Jo Bowers of Bonsall, California, and WHEREAS, the property is located north of Taos Drive and west of Roundup Avenue. This land is accessed via 1-40 at the D.W. Ranch Road exit, then east on the 1-40 Frontage Road, then south on Roundup A venue to the site, and WHEREAS, the site is mostly flat to slightly rolling and vacant. There are no residences in the area except one to the south of the property, and WHEREAS, the owner intends to split the property into four four-acre parcels and a twenty-acre parcel, and WHEREAS, there are no significant washes or drainage that cross the property. Review of Floodplain Map #040058-2350C indicates that this parcel lies within Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The eastern parcels be zoned A-R/4A (Agricultural-ResidentiallFour Acre Minimum Lot Size) and the western parcel by zoned A-R/J8A (Agricultural-ResidentiallEighteen Acre Minimum Lot Size).. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. . . That the Board of Supervisors accepts the dedication of 20-foot radius curves at all roadway intersection points adjacent to the property. 4. That the Board of Supervisors accepts the dedication of an additional 265-foot radius curve centered at the roadway angle point along the south property boundary to provide sufficient road right-of-way to allow traffic to safely negotiate the roadway bend at 25 miles per hour. This will be in accordance with the American Association of State Highway and Transportation Officials design and Standards for Geometric Design of Highways and Streets. 5. That the Board of Supervisors accepts the granting of an 8-foot PUE along the perimeter of the property. 6. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 7. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 8. Each parcel shall have legal access. 9. The Parcel Plat shall show any surface drainage and FEMA flood zones. 10. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. II. The Rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 12. If these conditions are not met within one year, this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, I1-S32. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December IS, 1994, and posted on December 19,1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, ATTEST: MOHA VE COUNTY BOARD OF SUPERVISORS ~_ ~.
