PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING .EE 0.00 HC RESOLUTION NO. 95-12 A RESOLUTION SETTING FORTH A REZONE OF THE EAST 622.17 FEET OF THE SW 1/4, SECTION 19, TOWNSHIP 24 NORTH, RANGE 14 WEST FROM A-R/36A (AGRICULTURAL- RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Garce Futerer of Prescott, Arizona, and WHEREAS, the property is located east of Antares Road and north of Huntington Avenue. This land is accessed via Highway 66, then north on Antares Road, then east on Huntington Avenue to the site, and WHEREAS, the site is mostly flat and vacant without any residences in the surrounding area. The owner intends to split the property into three five-plus-acre parcels and one ten-plus-acre parcel. There are no similar acreage splits in the area, and WHEREAS, there are no significant washes or drainage that cross the property. Review of Floodplain Map #040058-2025B indicates that this parcel lies within Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14,1994, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The three northern parcels be zoned A-R/5A (Agricultural-Residential! Five Acre Minimum Lot Size) and the southern parcel be zoned A-R/IOA (Agricultural-Residential/Ten Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accepts the dedication of the existing ingress/egress easements on the western boundary of the parcel and that the roadway shall be named Stormcliff Lane. In addition, the Board accepts 20- foot radius curves at all dedicated roadway intersection points. RESOLUTION NO. 95-12 Page 2 .4 - -.... . . PAGE 2 OF 2 6K 251~ PG 32+ (FEE.9~- 2011) 4. That the Board of Supervisors accepts the granting of an 8-foot PUE along the dedicated roadways. 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building enviromnental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If these conditions are not met within one year, this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6,11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 18, 1994, and posted on December 19,1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
