'-..:::c::>.,.-;' ../!.',:, , I!\.\(",y '~_.'!V RESOLUTION NO. 95-10 A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON A PORTION OF THE N 1/2, SW 114, NW 1/4 OF SECTION 19, TOWNSHIP 21 NORTH, RANGE 20 WEST, FOR THE ESTABLISHMENT OF LIQUID WASTE RECYCLING PONDS IN A M (MANUFACTURING) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Specific Use Permit for the above described property to Harry and Janet Daniell, Daniells Septic Service, Bullhead City, Arizona, and WHEREAS, this property is located two miles northeast of Bullhead City and north of Highway 68, and is accessed from Highway 68 via Katherine Mine Road, which is an undocumented roadway, and WHEREAS, the surrounding land uses to the proposed site consist of a single family residence to the south with the remainder of the area vacant. There is BLM land to the north and east, State land to the west and private land to the south, and WHEREAS, the topography of the area has a variety of washes which have channelled through the terrain creating small steep hills, and WHEREAS, the developer of the site proposes liquid waste recycling ponds for septic and sewer sludge, and WHEREAS, review of Floodplain Map #040058-2280C indicates this parcel is located in Zone C, not in the FEMA Special Flood Hazard Area; a floodplain use permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for a Specific Use Permit subject to the following: 1. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations. 2. That the Specific Use Permit be for liquid waste recycling ponds and activities related thereto; any new use will require a Specific Use Permit. \. . . The applicant comply with all applicable provisions of the Mohave County Zoning regulations and Section 27.P (Site Plan Requirements), including the following permits requested by the Public Works Department: a. Drainage Report to be approved by Mohave County Public Works. b. Mohave County Grading Permit (Section 70 of the Uniform Building Code). c. All ADEQ permitting applications and Approvals to Construct. d. US Army Corps of Engineers 404 permit and EPA 401 permits, if required. e. Concurrence from ADOT for access onto State Route 68. f. A preliminary Record of Survey was submitted to the Public Works Department depicting a 50 foot right-of-way on BLM property. A Record of Survey to include recorded access to the site is required to provide legal access to the site. 5. All these conditions must be met prior to the beginning of operation of the recycling ponds. 6. If construction or use has not commenced within one year of Board approval of the Specific Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Specific Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December IS, 1994, and posted December 19, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 3, 1995, APPROVED this Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
