IIICllOFIUlED RESOLUTION NO. 95-7 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 85 AS SHOWN IN RECORD OF SURVEY, BOOK 1, PAGE 48, SECTION 15, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-RlI0A (AGRlCULTURAL-RESIDENTIAUfEN ACRE MINIMUM LOT SIZE) ZONE TO A- Rl4A AND A-Rl8A (AGRICULTURAL-RESIDENTIALlFOUR ACRE AND EIGHT ACRE MINIMUM LOT SIZE) ZONES IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Michael and Josephine Whitton of Hesperia, California, and WHEREAS, the property is located south of Shipp Drive and west of Aztec Road. This land is accessed via Highway 68, then south on Aztec Road to the site, and WHEREAS, the property is flat and vacant. There are some scattered residences to the east of the site. There are power lines that run east to west along Shipp Drive adjacent to the property, and WHEREAS, the owner proposes to split the property into five parcels, three eight-acre and two four- acre parcels. There are several splits in the immediate area that are similar in acreage, and WHEREAS, there are no significant washes or drainage that cross the property. Review of Floodplain Map# 040058- 2325B indicates that this parcel lies within Zone A, an area of lOO"year flood, base flood elevations and hazard factors not determined. This parcel requires a Floodplain Use Permit for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for a Rezone subject to the following: I. The NE 1/4 of Parcel 85 be zoned A-Rl4A (Agricultural-ResidentiallFour Acre Minimum Lot Size) and the remainder of Parcel 85 be zoned A-Rl8A (Agricultural-Residentia1JEight Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. ~ . . That the Board of Supervisors accepts the dedications of the 30-foot roadway on the western boundary known as Arivaga Road and the 3D-foot roadway on the southern boundary known as Crystal Drive. In addition, the Board accepts 20-foot radius curves at all dedicated roadway intersection points. 4. That the Board of Supervisors accepts the granting of an 8-foot PUE along the perimeter of the parcel adjacent to roadways. 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If these conditions are not met within one year, this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 18, 1994, and posted on December 19,1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
