RESOLUTION NO. 95-2 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR MOON VALLEY, TRACT 4120, BEING A SUBDIVISION OF A PORTION OF THE NE 1/4, SW 1/4, SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHA VE V ALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 3, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described property to owners/developers Delmar 1. and. Janice K. Tilton of Port Orchard, Washington. The engineering firm responsible for the design and drainage study is Territorial Engineers, Incorporated, of Bullhead City, Arizona, and WHEREAS, this approved subdivision is located two and one-half miles south of Bullhead City's southernmost boundary and is approximately one and one-quarter miles east of Highway 95, and WHEREAS, this property is bordered on the north by the proposed Sun Desert subdivision, on the south by the proposed Pine River Estates subdivision, on the west by Tierra Del Rio, Tract 4048-D, and on the east by unsubdivided properties. These projects are located on the western alluvial slope of the Black Mountains and are subject to flash flooding and sheet flow run-off. The Pine River Estates subdivision, Sun Desert Estates subdivision, and Moon Valley have been consolidated into one comprehensive drainage study, and WHEREAS, the Preliminary Plan depicts 5 acres subdivided into 16 residential lots. The lots range in size from 9,800 square feet to 12,375 square feet to yield a density of 3.2 units per acre. According to the developer, water service will be provided by the Bermuda Water Company, Inc. This property proposes to have private individual disposal systems for sewage disposal. The project is located within the Mohave Valley Irrigation and Drainage District, and WHEREAS, Article 3.10 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and -.- - . . .. ~ RESOLUTION NO. 95-2 Page 2 PAGE 2 OF 2 8K 2510 PG ~41 (FEEt9~- 37Q) WHEREAS, in a letter received by Planning and Zoning on November 2, 1994, D. L. Tilton states that the Extension of Time is needed because the access to this subdivision will not exist until the Sun Desert Subdivision is developed. All utilities must be routed through Sun Desert, also. In the letter he advises that it is their intent to develop Moon Valley as soon as Sun Desert builds the access road and brings the utilities to the property line, and WHEREAS, the Preliminary Subdivision Plan was approved by the Mohave County Board of Supervisors on March 4, 1991, via Resolution No. 91-63. BOS Resolution No. 91-337, dated December 16, 1991, approved the Final Plat which has not yet been recorded. This will serve as the first and second Extensions of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 14, 1994, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions as stated in BOS Resolution Nos. 91-63 and 91-337. 2, Submittal of revised or recertification of cost estimate to be approved by the County Engineer. 3. This Extension of Time will be in effect until December 16, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 18, 1994, and posted December 19, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 3,1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
