RESOLUTION NO. 95-97 A RESOLUTION SETTING FORTH A REZONE OF TAX PARCEL #310-03-093, AS SHOWN ON MOHA VE COUNTY ASSESSOR'S MAP DATED APRIL 22,1992, IN A PORTION OF THE E 1/2 OF THE E 1/2 OF THE NE 1/4 OF SECTION 6, TOWNSHIP 22 NORTH, RANGE 16 WEST FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A- R/5A (AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to deter, line whether approval should be granted for a Rezone for the above described property to SMK Limited Partnership of Kingman, Arizona, and WHEREAS, the property is located north of Calle Dimas and west of Bank Street. This land is accessed via Stockton Hill Road, then east on Jane Avenue, then south on Cherum Road, then east on Calle Alamo, then south on Bank Street to the site, and WHEREAS, the site is slightly rolling and vacant. There are scattered residences to the west and one residence to the north. The owner proposes to split the 29.2 acres into five parcels containing five-plus acres each. There are several parcels in the area that have been split to five acres. Power lines run east to west on the south side of Alamo Road, and WHEREAS, there is some minor drainage that crosses the property. Review of FEMA FIRM Panel #040058-2155B indicates that this parcel lies within Zone C, not in a FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The parcels be zoned A-R15A (Agricultural-ResidentiallFive Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B ofthe Standard Specifications. 3. That the Board of Supervisors accepts the granting of an 8-foot PUE adjacent to the roadway. . . . RESOLUTION NO. 95-97 PAGE 2 OF 2 BK 2538 PG 79~ (FEE~95-12844! Page 2 , 4. The grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The parcel plat shall show any surface drainage and FEMA flood zones. 8. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective for 30 days after [mal Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted on February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
