PAGE 1 OF 3 ciOHAVE cmmn Bor,RD DF SUPERVISORS RECORDING FEE 0.00 HC , RESOLUTION NO. 95-95 A RESOLUTION SETTING FORTH A REZONE OF LAZY Y -U RANCH, PHASE I, AMENDED, PARCEL 6, IN SECTION 3, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALlTHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A- R/5A (AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Kingman 40 Partnership of Phoenix, Arizona being represented by Thomas R. Christopher of Mohave Engineering Associates, Inc., of Kingman, Arizona, and WHEREAS, the property is located approximately two and one-half miles southeast of the Kingman city limits, south of Hualapai Mountain Road. This property is accessed from Hualapai Mountain Road via south on Lazy YoU Drive, then northwest on Lazy Y-U Drive to Indian Pony Drive, then north on Indian Pony Drive to the site, and WHEREAS, the site is vacant and there are no residences in the area. There are no significant drainage patterns that cross the property. The landscape rises abruptly from the southern portion of Parcel 6, levels off toward the northeastern portion of the parcel and slopes abruptly down the other side where the terrain slopes abruptly downward into Parcel 3, and WHEREAS, according to the surveyor, the proposed extension of Indian Pony Drive is plotted at 10 percent, not to exceed a 12-percent grade. The steep grade of the upper portion of Indian Pony Drive's current alignment where it passes through Parcel 3 and into Parcel 6 exceeds 18 percent. Traction on this section of the roadway may be difficult in a two-wheel drive vehicle, and WHEREAS, Citizens Utilities is requesting that a 16-foot PUE be granted along the western boundary of Parcel 6 south of Indian Pony Road and along the southern boundary to the southeastern parcel. This will serve as an alternative to the PUE alignment proposed by the engineer. WHEREAS, this item was denied by the Mohave County Planning and Zoning Commission on March 8, 1995. Because of a change made by the engineer, the item was pulled from the Board of Supervisors April 1995 agenda., The lot lines were realigned, making the parcels more buildable. The approved General Plan designates this to be a rural area, and WHEREAS, review of Floodplain Map #040058-2350C indicates that this parcel lies within Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and . . . RESOLUTION NO. 95-95 PAGE 2 Of 3 Page 2 BK 2591 PG 413 (FEE~95-35071) WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The four southern parcels will be rezoned A-R15A (Agricultural-ResidentiallFive-Acre Minimum Lot Size) and the northern parcel will be rezoned A-R17A (Agricultural- Residential/Seven-Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and l02.04-B of the Standard Specifications is required. 3. That the Board of Supervisors accepts the granting of a SO-foot ingress/egress easement on the northeast portion of the property complete with a 45-foot minimum radius cul-de-sac bulb. NOTE: Section 6.4-11 of the Mohave County Subdivision and Road Maintenance Regulations states, "Road and street grades shall be limited to a maximum of sixteen (16) percent for paved roadways and a maximum of twelve (12) percent for thoroughfares and gravel roadways." 4. That the Board of Supervisors accepts the granting of the eight feet adjacent to the proposed SO-foot ingress/egress as a Public Utilities Easement (PUE). 5. The grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board upon Parcel Plat recordation. 6. The roadway easement centerline will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel corners. 7. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 8. Each parcel shall have legal access. 9. The Parcel Plat shall show any surface drainage and FEMA flood zones. lO. That the appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 1 1. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. . . RESOLUTION 1';0. W5 12. . If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved. the Board of Supervisors (after notification by registered mail to the owner and applicant who requcsted the rezoning) shall schedule a public hearing to grant an extension, determine compliance with tbe schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 1 1, Chapter 6, ] 1 -832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, July 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
