WHEREAS. at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to McBrayer Mortgage Company of Kingman, Arizona, and WHEREAS, the property is located two and one-half miles southeast of the Kingman city limits. This land is accessed from Hualapai Mountain Road via Lazy YoU Drive, then southeast on Tomahawk Drive to the site, and WHEREAS, the site is vacant and there are no residences in the area. Parcel 35C is split in half by Tomahawk Drive. The portion of the site that is west of the roadway is sloped toward the west and appears to contain several minor drainage ways. The property slopes upward toward the east on the far eastern portion of the property, and WHEREAS, there are some minor drainage areas on Parcel 35C west of Tomahawk Drive. Review of FEMA FIRM Panel #040058-2350C indicates that this parcel lies within Zone C, not in a FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The proposed Parcels 35C-2 and 35C-3 be zoned A-R14A (Agricultural-ResidentiallFour Acre Minimum Lot Size) and the proposed Parcel 35C-I be zoned A-R115A (Agricultural- ResidentiallFifteen Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. Roadway easement centerlines will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel corners. ... . . RESOLUTION NO. 95-94 PAGE 2 OF 2 BK 2542 P6 145 (fEEt'S-14409l Page 2 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. 6. The parcel plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted on February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10, 1995, APPROVED a Rezone of these parcels to A-R15A (Agricultura1- ResidentiallFive Acre Minimum Lot Size).
