MICROFILME13 RESOLUTION NO. 95-93 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 46, LAZY Y -U RANCH, PHASE I, SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST FROM A-R/36A (AGRICUL TURAL- RESIDENTIAL/TIDRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A, A-R/I0A AND A- R/15A (AGRICULTURAL-RESIDENTIALIFIVE ACRE, TEN ACRE AND FIFTEEN ACRE MINIMUM LOT SIZE) ZONES IN THE MORAVE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Daniel, Alora and Jane Barkhurst of Kingman, Arizona, and WHEREAS, the property is located approximately two and one-half miles southeast of the Kingman city limits. This land is accessed from Lazy YoU Drive via Hualapai Mountain Road, then east on Buckboard Trail, then south on Stallion Drive, then southwest on Stallion Lane to the site, and WHEREAS, the site is vacant and is located in mountainous terrain. The landscape of the site from Stallion Lane drops into a ravine containing a significant wash and then rises steeply in a southerly direction, levels off and then slopes again toward the south, and WHEREAS, according to the Mohave County Public Works Department, the built-up roadway section that crosses a drainage area on the property has the potential to be washed out in the event of major runoff. They recommend the owner seek the advice of an engineer for the possible placement of a culvert, and WHEREAS, there are at least two significant washes or drainage areas located on this property. Review of FEMA FIRM Panel #040058-2350C indicates that this parcel lies within Zone C, not in a FEMA Special Flood Hazard Area. A FloodplaIn Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The northeast parcel be zoned A-R15A (Agricultural-ResidentiallFive Acre Minimum Lot Size), the southeast parcel be zoned A-R110A (Agricultural-Residential/Ten Acre Minimum Lot Size) and the western parcel be zoned A-R115A (Agricultural-Residential/Fifteen Acre Minimum Lot Size). Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accepts the granting of a 50-foot ingress/egress easement providing legal access for the proposed parcels. NOTE: Section 6.4-11 of the Mohave County Subdivision and Road Maintenance Regulations states, " Road and street grades shall be limited to a maximum sixteen (16) percent for paved roadways and a maximum of twelve (12) percent for thoroughfares and gravel roadways." 4. That the Board of Supervisors accepts the granting of an 8-foot PUE adjacent to the proposed 50-foot ingress/egress easement. 5. The grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board upon Parcel Plat recordation. 6. Roadway easement centerlines will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel corners. 7. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 8. Each parcel shall have legal access. 9. The parcel plat shall show any surface drainage and FEMA flood zones. 10. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 11. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 12. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted on February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. PAGE 3 OF 3 3K 2538 PG 790 (FEE~95-12842) RESOLUTION NO. 95-93 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
