RESOLUTION NO. 95-92
A RESOLUTION SETTING FORTH A REZONE OF GOVERNMENT LOT #3, SECTION 5,
TOWNSIDP 24 NORTH, RANGE 14 WEST FROM A-R/36A (AGRICULTURAL-RESIDENTIAL!
TIDRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/I0A (AGRICULTURAL-
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY
GENERAL AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property to Giant Quicksilver Corporation of Larkspur, California, and
WHEREAS, the property is located south of Drum Road and west of Harp Way in Music Mountain
Ranches. This land is accessed via Highway 66, then northwest on Antares Road, then north on Classical
Drive, then east on Tres Drive, then north on Guitar Drive to the site, and
WHEREAS, the site is vacant and slightly rolling toward the north. There are no residences or other
development in the area, and
WHEREAS, the owner proposes to split the 57 acres into five parcels containing ten-plus acres.
There are a few parcels in the immediate area that have been split down to ten acres, and
WHEREAS, there is some minor drainage on the site. Review of FEMA FIRM Panel #040058-
2025B indicates that this parcel lies within Zone C, not in a FEMA Special Flood Hazard Area. A
Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The parcels be zoned A-R1IOA (Agricultural-ResidentiallTen Acre Minimum Lot Size).
2. Submittal and recordation ofa parcel plat prepared in accordance with Article 3.16 of the
Mohave County Subdivision Regulations and 102.04.B of the Standard Specifications.
3. That the Board of Supervisors accept the dedication of 30. foot roadways on the western and
southern boundaries, a 42-foot roadway on the northern boundary and a 35-foot roadway on
the eastern boundary of the parcel. In addition, 20- foot radius curves are required at all
dedicated roadway intersection points.

4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to the
dedicated roadways.
5. The dedications and grantings required by the rezone resolution shall be shown on the Parcel
Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The parcel plat shall show any surface drainage and FEMA flood zones.
9. That appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11.829E.
11. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension,
determine compliance with the schedule for development, or cause the property to revert to
its former zoning classification. This action is in accordance with Arizona Revised Statutes
Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted on February 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Friday, March 10, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
