HomeMy WebLinkAbout95-089 ~<;>5- 95~ :; . 8D~ - -5 ~~CROf]LMEO iNDEXED RESOLUTION NO. 95-89 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR SUNLAKE VILLAGE, TRACT 3700-A, BEING A PORTION OF THE S 1/2 OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, LOCATED IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held April 17 , 1995, a public hearing was conducted to determine the approval of the final subdivision plan for Sunlake Village, Tract 3700, and WHEREAS, the subdivision will be completed in phases. Tract 3700-A will be the first phase of this development, and WHEREAS, the subdivision will be served by an on-site treatment plant located on proposed Lot 55. A number of the lots in Phase I will be using on-site septic tanks. All lots not using on-site septic tanks will be using temporary storage vaults for sewage disposal. The temporary vault is located on future Parcel E. Lot 55 and Parcel E are both located in future phases. Agreements have been made to assure the future use of the sewage disposal systems. Temporary easements have also been put in place for the utility lines servicing Phase I where they cross the property in future phases of the subdivision, and WHEREAS, the Preliminary Plan depicts 56-plus acres subdivided into 160 single-family residential lots and one commercial lot which will be developed at a later date. The single-family residential lots range in size from 7,500 to 13,230 square feet, and the commercial lot is approximately 75,000 square feet, and WHEREAS, electric power, telephone, gas and water will be provided by Citizens Utilities Company; sewage treatment by on-site septic systems; and solid waste disposal by Laidlaw Lake Havasu Disposal. Cable television will also be provided. Desert Hills Fire Department will provide fire protection, and WHEREAS, the subdivision will be served by an on-site sewage treatment plant. The plant will be located on Lot 55. Since many of the lots are not usable because septic systems cannot be installed an alternative plan is being requested. The plan includes using temporary storage tanks (vault and haul) and an on-site treatment plant, and WHEREAS, the Final Plat and all required documentation for Sunlake Village, Tract 3700, has been reviewed by staff. The requirements of the Preliminary Plan have been satisfied, and RESOLUTION NO. 95-89 Page 2 . . WHEREAS, the Revised Preliminary Plan for this subdivision was granted approval on February 6, 1995, via BOS Resolution No. 95-30. All applicable conditions set forth in Resolution No. 95-30 will need to be satisfied before recordation of the Final Plat, and WHEREAS, the Board of Supervisors APPROVES the Final Subdivision Plan for Tract 3700-A, subject to the following: I. Arizona Department of Environmental Quality approvals will be required pnor to recordation of the Final Plat. 2. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as required for approval of this tract by the Board and a final copy of the State Real Estate Report shall be submitted to the Planning and Zoning Department. 3. An assured supply of water (lOO-year) shall be approved by the Arizona Department of Water Resources. 4. An approved method of assurance and/or surety shall be provided in the amount of the approved cost estimate as approved by the Mohave County Public Works Department for the final recorded plat, in its entirety, and all required site improvements. 5. A current Title Report (dated within 30 days of recordation) must be furnished to the Planning and Zoning Department prior to recordation. 6. The Board of Supervisors approves the zone change separately and simultaneously with the recording of the Final Plat. 7. The Homeowners Association will need to be incorporated prior to recordation of the Final Plat. 8. Recording information for the abandonment of the ingress/egress easement on the southern boundary of the subdivision needs to be noted on the plat prior to recordation of the Final Plat. 9. The existing ingress/egress easement on the east side of the subdivision needs to be shown on the plat. A note should be added indicating that the ingress/egress will be abandoned by separate instrument. PAGE 2 OF 3 BK 2559 P6 955 (FEE~9!5-21888) . . RESOLUTION NO. 95-89 Page 3 WHEREAS, a correct copy of all documents delineated above shall be submitted for staff review and upon receipt of the evidence thai these conditions have been met. together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County departments and officials and cause the Final Plat for Tract 3700-A to be recorded. NOW THEREFORE BE IT RESOLVED, the notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through the advertisement of the Board of Supervisors meeting for this date. NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of Supervisors, at their special meeting on Monday. April 17, 1995, APPROVED this Subdivision as outlined herein.
