HomeMy WebLinkAbout95-084 ~~ ~ . 3 M1CROFlLMED RESOLUTION NO. 95-84 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR DESERT LAKES F, TRACT 4132, BEING A SUBDIVISION OF THE NE 1/4, OF THE NW 1/4 OF THE NE 1/4 SECTION 35, TOWNSIDP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granteltfor an Extension of Time to Sterling Varner, Vice President/Project Coordinator, Desert Lakes Develo'pment , Ft. Mohave, Arizona, for the above described Preliminary Subdivision Plan for Desert Lakes F, Tract 4132, and WHEREAS, the owner/developer of this tract is Angelo Rinaldi, Desert Lakes Development, L. P. of Fort Mohave, Arizona. The engineer of record is Holland West, Inc, Bullhead City, Arizona, and Englewood, Colorado, and WHEREAS, the subdivision is located south of Bullliead City at the southwest corner of Joy Lane and Club House Drive. The Preliminary Plan depicts 38 single family lots, and two water well parcels, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on December 2, 1991, per BOS Resolution No. 91-331. An Extension of Time was required in December, 1993, but was not applied for. The developer has submitted fees for the previously required and current Extension of Time. This extension will bring the Preliminary Plan up to date. "Upon application to the Commission and prior to the expiration, of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated," and WHEREAS, the developer of the project has indicated in a letter dated December 19, 1994 that an Extension of Time is being requested based on the following; "The delay in work on this tract has been due to two major factors: the general slow down oflot sales in the area, and the finishing up of many loose ends in the Los Logos and the previous Desert Lakes tracts. Preliminary construction plans have been completed, and Desert Lakes Development is planning to continue on Tract 4132 in 1995," and WHEREAS, this will be the second Extension of Time, and , . . PAGE 2 OF BK 2538 PG ., ~ 773 (fEEt95-12834) Page 2 RESOLUTION NO. 95-84 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for an Extension of Time for a Preliminary Plan subject to the following: I. Compliance with all conditions ofBOS Resolution No. 91-331. 2. This Extension of Time will be in effect until December 2, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County Arizona, February 19, 1994, and posted February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning as Zoning Commission and outlined herein.
