RESOLUTION NO. 95-83 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR FAIRWAY ESTATES, TRACT 4097, BEING A PORTION OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to Glen L. Ludwig, Ludwig Engineering, San Bernardino, California, for the above described Preliminary Subdivision Plan for Fairway Estates, Tract 4097, and WHEREAS, the owner/developer of this tract is Glen L. and Pearle A. Ludwig, San Bernardino, California. The engineer of record is Richard J. Rieker, P.E. of Ludwig Engineering, San Bernardino, and WHEREAS, the subdivision is located south of Bullhead City and east of Highway 95 at the southwest corner of Joy Lane and Mountain View Road. The Preliminary Plan depicts approximately 65 acres subdivided into 278 single family lots, and a parcel for Commercial or Multiple Family use, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on February 5, 1990, per BOS Resolution No. 90-35. The first Extension of Time was granted on February 3, 1992 per BOS Resolution No. 92-32, the second Extension of Time was granted on October 4, 1993 per BOS Resolution No. 93-275 and the third Extension of Time was granted on April 4, 1994, per BOS Resolution No. 94-94. Article 3.10-1 states, "Upon application to the Commission and prior to the expiration, of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated," and WHEREAS, the developer of the project has indicated in a letter dated December 21, 1994 that an Extension of Time is being requested based on the following; "F~ay Estates has been continually active since 1990 and is a single family housing project. Buyers select one of the eight models offered which is built upon the lot of their choice. Tract 4097 consists of five phases of which two have been recorded (Tracts 4097-A and B). The remaining three phases, Tracts 4097-C, D, E, received conditional approval of the Final Plat and Improvement Plans by the Board of Supervisors on June 15 1992. At that time, it was determined to be premature to manufacture additional lots because sufficient lot inventory was available which is still the case. It is noteworthy to mention that Mountain View Road, which was built in conduction with the three phases, has been constructed together with a perimeter masonry wall. All off-side and support infrastructure has been installed for the entire Fairway Estates project including the clubhouse and its related ancillary facilities. The entire project has been graded with only precise grading remaining. Neither the existing recorded subdivision nor any area outside the subdivision is depicted upon the completion of the in-tract improvements within the remaining phases," and , "/ . . RESOLUTION NO. 95-83 PAGE 2 OF 2 BK 2538 P6 771 (FEE~95-12833) Page 2 WHEREAS, this will be the fourth Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for an Extension of Time for a Preliminary Plan subject to the following: I. Compliance with all conditions ofBOS Resolution Nos. 90-35, 92-32, 93-275, and 94-94. 2. This Extension of Time will be in effect until February 5, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County Arizona, February 19, 1994, and posted February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10,1995, APPROVED this Extension of Time as recommended by the Mohave County Planning as Zoning Comniission and outlined herein.
