HomeMy WebLinkAbout95-081 ,. :'i> ~~ . 3 MICROFILMED RESOLUTION NO. 95-81 A RESOLUTION SETTING FORTH A REZONE OF LOT 55, SUNLAKE VILLAGE, TRACT 3700, SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM R-1I3A (SINGLE FAMILY RESIDENTIALrrHREE ACRE MINIMUM LOT SIZE) ZONE TO M (GENERAL MANUFACTURING) ZONE FOR THE ESTABLISHMENT OF A WASTE WATER TREATMENT PLANT IN THE LAKE RA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Scott F. Ward ofFTF Investments, Tempe, Arizona. Mr. Ward is requesting this rezoning for a waste water disposal plant to be used for the proposed Sunlake Village, Tract 3700, and WHEREAS, this property is located adjacent to the Lake Havasu City limits, northwest of the city limits and west of Highway 95, and is accessed from Highway 95 via Lake Drive west to Kenneth Lane, then south on Kenneth Lane to Diane Drive, then east on Diane Drive to Jacob Row, then southeast on Jacob Row to the site. The site is located south of Jacob Row, and WHEREAS, the surrounding land uses to the proposed site consists of a mobile home park to the north and west and a mini-storage also on the north side. Lake Havasu City limits is on the south boundary of this project. Highway 95 makes up the eastern edge of the proposed subdivision, and WHEREAS, review ofFEMA FIRM Panel #040058-3 I lOB indicates this parcel to be in Zone C, not in a FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. Lot 55 will be zoned M (General Manufacturing) and all uses will require a Specific Use Permit. 2. Zoning ~ill be vested upon recordation of the Final Plat for Phase I of Sun lake Village, Tract 3700. If this subdivision does not record, the zoning for this parcel will revert to R-1/3A (Single Family Residential/Three Acre Minimum Lot Size). "'Y . . Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The applicant will provide a six-foot block wall around this project; parcel 56 and parcel 55 will be landscaped. 5. The appropriate zoning, building, environmental and floodplain permits be obtained. 6. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS ll-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
