MiCROfiLMED RESOLUTION NO. 95-59 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE E 1/2 OF PARCEL 10, STOCKTON HILL RANCHES, UNIT XII, SECTION 5, TOWNSHIP 23 NORTH, RANGE 16 WEST FROM A-RlI0A (AGRICUL TURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-Rl5A (AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 6, 1995, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to Michael and Teresa Hubbard of Vista, California, and WHEREAS, the property is located south of Calle Valdez and west of Avenida Obregon. This land is accessed via Stockton Hill Road, then east on Calle Lucero, then north on Dubrois Drive to the site, and WHEREAS, this land is primarily flat with no significant drainage on site. The land is vacant with no residences adjacent to the parcel. The l5-plus acres are being split into three parcels, each containing five-plus acres. The created parcels are in conformance with the Long Mountain Area Plan, and WHEREAS, review of FEMA FIRM Panel #040058-2000B indicates that this parcel is located in Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January II, 1995, the Commission recommended APPROVAL for a rezone subject to the following: I. The parcels be zoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accept the dedication of a 30-foot roadway on the northern boundary ofthe parcel, and two 20-foot radius curves on the northeast and southeast comers of the parcel. 4. That the Board of Supervisors accept the granting of an 8-foot PUE along the north, east and south boundaries of the parcels. . . The dedications and grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezcne shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 22, 1995 and posted on January 20, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on February 6, 1995, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
