RESOLUTION NO. 95-54 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 35-2, MOUNTAIN VISTA RANCHES, AS SHOWN BY RECORD OF SURVEY BOOK 11, PAGES 34-34G, SECTION 35, TOWNSHIP 24 NORTH, RANGE 15 WEST FROM A-Rl36A (AGRICULTURAL- RESIDENTIALrrHffiTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-Rl5A (AGRICUL TURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 6, 1995, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to Giant Quicksilver of Larkspur, California, and WHEREAS, the property is located north of Superstition Drive and east of Mohave Road. This land is accessed via Highway 66, then north on Concho Drive, then east on Superstition Drive, then north on Mohave Road to the site, and WHEREAS, the site is vacant and flat. There are no other residences in the area. The owner intends to split the 40-acre property into four, five-acre parcels and one parcel containing 15 acres plus. There are similar splits in the area, and WHEREAS, there are no significant washes or drainage that cross the property. Review of FEMA FIRM Panel #040058-2025B indicates that this parcel lies within Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 11, 1995, the Commission recommended APPROVAL for a rezone subject to the following: L The western half of Parcel 35-2 be zoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) and the eastern half of parcel 35-2 be zoned A-R/15A (Agricultural- Residential/Fifteen Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accepts the dedication of the existing 42-foot ingress/egress easement and PUE along the north portion ofthe property, the existing 30-foot ingress/egress --. - ...-~ . . PAGE 2 OF 2 Page 2 BK 2526 PG 605 (fEE~~!5- 7535) and PUE along the west portion of the property, and the proposed 30-foot ingress/egress along the south portion of the property. In addition, that the Board accepts 20-foot radius curves at all dedicated intersection points. RESOLUTION NO. 95-54 4. That the Board of Supervisors accepts the dedication of an 8-foot PUE adjacent to the dedicated roadways. 5. The dedications and grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That appropriak zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 1 I. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, i\rizona, Mohave County, Arizona, January 22, 1995 and posted on January 20, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on February 6, 1995, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
