A RESOLUTION SETTING FORTH A REZONE OF PARCEL 35-7A, MOUNTAIN VISTA
RANCHES, PHASE I, AS SHOWN BY BOOK 8, PAGE 99 OF PARCEL PLATS, SECTION 35,
TOWNSHIP 24 NORTH, RANGE 15 WEST FROM A-R/10A (AGRIcULTURAL-
RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRIcULTURAL-
RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY
GENERAL AREA, MOHA VE COUNTY ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property to Chris Mousley of Kingman, Arizona, and
WHEREAS, the property is located north of Del Norte Street and east of Lloyd Road. This land
is accessed via Highway 66, then north on Concho Drive, then east on Superstition Drive, then south on
Lloyd Road, then east on Del Norte Street to the site, and
WHEREAS, the site is flat and vacant. There are no residences or development in the area. The
owner proposes to split the 17.5 acres into three parcels consisting of five-plus acres each. There are several
splits in the area that are of similar acreage, and
WHEREAS, there are no significant washes or drainage that cross the property. Review of FEMA
FIRM Panel # 040058-2025B indicates that this parcel is within Zone C, not in a FEMA special flood hazard
area. A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The parcels be zoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size).
2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the
Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications.
3. That the Board of Supervisors accepts the dedication of the 30-foot roadway on the eastern
boundary of this property. In addition, a 20-foot radius curve is required at the dedicated
roadway intersection on the eastern boundary.

4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to the
roadway.
5. The grantings and dedications required by the rezone resolution shall be shown on the parcel
plat and accepted by the Board upon parcel plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The parcel plat shall show any surface drainage and FEMA flood zones.
9. That appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until parcel plat recordation.
10. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11-829E.
11. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension,
determine compliance with the schedule for development, or cause the property to revert to
its former zoning classification. This action is in accordance with Arizona Revised Statutes
Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, March 19,1995 and posted on March 17, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
