MOHAVE COUMTY RECQROER~ 04/05/9'5 i: 15 P,D, PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC 3 MICIIOrltMED RESOLUTION NO. 95-145 A RESOLUTION SETTING FORTH A REZONE OF PARCELS 35-F AND 35-G, AS SHOWN IN BOOK 11, PAGE 49 OF RECORDS OF SURVEY, SECTION 35, TOWNSHIP 24 NORTH, RANGE 17 WEST FROM A-R/36A (AGRIcUL TURAL-RESIDENTIALrrHIRTY -SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/10A AND A-R/20A (AGRIcULTURAL-RESIDENTIALrrEN ACRE AND TWENTY ACRE MINIMUM LOT SIZE) ZONES IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Aimee I. Pernicano of San Diego, California, and WHEREAS, the property is located in the Vock Canyon Ranches area, Unit #2. This land is accessed via Stockton Hill Road, then west on V ock Canyon Road approximately one mile to the site, and WHEREAS, the site is vacant and flat. The land rises abruptly on the northern boundary and on the southern boundary of the property, and WHEREAS, the two parcels are adjacent under the same ownership. Parcel 35-F is 39.2 acres and is being split into one twenty-acre parcel and one ten-acre parcel. Parcel 35-G is 36.0 net acres and is being split into three ten-acre parcels. There are a few parcels which are 160 acres but most of the splits in the area are down to 40 acres. There are, however, two parcels to the west which are of lower acreage. One parcel is four acres and the other is 18 acres. There are no other splits in the area that have similar acreage to the proposed rezone, and WHEREAS, there is some drainage on the north side of V ock Canyon Road. This parcel contains a flood hazard not shown on the FEMA map, but is recognized by the Mohave County Flood Control District. Review of FEMA FIRM Panel # 040058-2000B indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8,1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The parcels be zoned A-R/IO (Agricultural-Residential/Ten Acre Minimum Lot Size) and the western parcel be zoned A-R/20A (Agricultural-ResidentialJTwenty Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. RESOLUTION NO. 95-145 Page 2 '" . . ~ ~. 3. That the Board of Supervisors accepts the dedication of that portion of V ock Canyon Road affected by this development. In addition, 20-foot radius curves are required at all dedicated roadway intersections. 4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to all dedicated roadways. 5. The grantings and dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until parcel plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 19, 1995 and posted on March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
