RESOLUTION NO. 95-143 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 45, IN THE NWV., SWv., NW'I. OF SECTION 25, TOWNSHIP 27 NORTH, RANGE 21 WEST, FOR THE ESTABLISHMENT OF OPEN LAND STORAGE, LIVING QUARTERS AND A SALVAGE YARD IN AN A (GENERAL) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to Barbara and David Speer of Kingman, Arizona, and WHEREAS, Mr. and Mrs. Speer are requesting this Zoning Use Permit for open storage, an office, living quarters for security, a salvage yard, covered and closed storage, and WHEREAS, the property is located west of Highway 93 and the White Hills Road intersection. The property is accessed from Highway 93 to the west via an undocumented road through Parcel 014 that is the west extension of White Hills Road to a road and public utilities easement (RD & PUE) , then north to an east-west RD & PUE, then west on this RD & PUE to the site. The property is located on the south side of this RD & PUE, and WHEREAS, the property is relatively flat and slopes to the east toward Highway 93. There are several structures, a travel trailer and several vehicles presently on the property. The surrounding land is vacant with Bureau of Land Management (BLM) land to the west, and WHEREAS, review ofFEMA FIRM Panel #040058-1600B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This facility will not be used as a salvage yard for motor vehicles but may be used as a recycling facility for aluminum, etc. 2. The applicant will provide a six-foot view-obscuring fence around this property. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and/or prior to commencement of use. RESOLUTION NO. 95-143 Page 2 . .-' . . 4. The appropriate zoning, building, environmental and floodplain permits will be obtained. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 19, 1995, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
