I );/V -"I R( 1-";....-' - -....- -.1. ala. -:2-:;) ;;> RESOLUTION NO. 95-142 \<.e"- </0 0 A RESOLUTION SETTING FORTH A REZONE OF THE Will, NW1;4 OF SECTION 1, TOWNSHIP 15 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICUL TURAL.RESIDENTlALI THlRTY.SIX ACRE MINIMUM LOT SIZE) TO M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to NewCut, Inc., John P. Allison, Project Manager, of Wichita, Kansas, and WHEREAS, the applicant is requesting this zone change to construct a non-chemical use mill site for their mining project, and WHEREAS, the property is located one and one-half miles southeast of Interstate 40. The property is accessed from Interstate 40 via the Franconia exit. The site is accessed from an old mining road, which is an undocumented roadway. The property is relatively flat with the terrain sloping to the southeast. The surrounding land is vacant, and WHEREAS, review ofFEMA FIRM Panel #040058-3000B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned M-X/10A (Heavy Manufacturing/Ten Acre Minimum Lot Size). The 10-acre parcel is shown on Exhibit "A" and is described as being 660 feet by 660 feet square and is located 301 feet south and 301 feet east of the northwest corner of Section 1, Township 15 North, Range 19 West. 2. A Specific Use Permit is required before this property can be developed. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained. > , . RESOLUTION NO. 95-142 Page 2 5. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14,1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May I, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
