PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING fEE Q.OO He RESOLUTION NO. 95-140 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 112G, AS SHOWN BY BOOK 6, PAGE 98 OF PARCELS PLATS, SECTION 13, TOWNsmp 21 NORTH, RANGE 18 WEST FROM A-R/4A (AGRICULTURAL-RESIDENTIAL/ FOUR ACRE MINIMUM LOT SIZE) ZONE TO A- R/2A (AGRICULTURAL-RESIDENTIALITWO ACRE MINIMUM LOT SIZE) ZONE IN THE GOLDEN V ALLEY GENERAL AREA, MOHA VE COUNTY ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Cain and Ann Couey of Bullhead City, Arizona, and WHEREAS, the property is located east of Bacobi Road and south of Shipp Drive. This land is accessed via Highway 68, then south on Bacobi Road, then east on Shipp Drive to the site, and WHEREAS, the site is flat and vacant. There are scattered residences in the area and one to the east. Powerlines run east to west on the south side of Shipp Drive, and WHEREAS, the owner proposes to split the 4.49-acre parcel in half. There are several parcels in the area which have been split to similar acreage, and WHEREAS, there are no significant washes or drainage that cross the property. Review of FEMA FIRM Panel # 040058-2325B indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The parcels be zoned A-R12A (Agricultural-ResidentiallTwo Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 4. Each parcel shall have legal access. 5. The parcel plat shall show any surface drainage and FEMA flood zones. RESOLUTION NO. 95-140 Page 2 '- . . . 6. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until parcel plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 19, 1995 and posted on March 17,1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
