RESOLUTION NO. 95-137 A RESOLUTION SETTING FORTH A REZONE OF THE NORTH 500 FEET OF THE WEST Y, OF PARCEL 10, SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM A-R/I0A (AGRICULTURAL-RESIDENTIALITEN ACRE MINIMUM LOT SIZE) ZONE TO C-2H (GENERAL COMMERCIALIIDGHWAY FRONTAGE) ZONE AND TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to EarlL. Nielsen of Bullhead City, Arizona, and WHEREAS, the property is located on the south side of Highway 68 between Laguna and Roosevelt Roads and is accessed from Highway 68, and WHEREAS, the property is flat, slopes to slightly to the south and is vacant. The surrounding land uses include a house to the south and a mini-mart to the west on the north side of Highway 68. The remaining property is vacant, and WHEREAS, review ofFEMA FIRM Panel #040058-2325B indicates these parcels to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The lots fronting on Highway 68 will be zoned C-2H110M (General Commercial Highway FrontagelTen Thousand Square Foot Minimum Lot Size) and the southern 240 feet will be zoned C-2/1A (General Commercial/One Acre Minimum Lot Size). 2. The submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specification is required to show the location of each parcel. 3. That the Board of Supervisors accepts the dedication of the east 30 feet of Glen Canyon Road, to include a minimum of a 30-foot radius curve at the intersection of Glen Canyon Road and State Route 68. 4. That the Board of Supervisors accepts the granting of an eight-foot public utility easement adjacent to the roadway, and following the roadway and radius curve. RESOLUTION NO. 95-137 Page 2 - . . -r. I~" ('-~.. 5. The grantings and dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. 6. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits, 7. The appropriate zoning, building, environmental and floodplain permits will be obtained. 8. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 19, 1995, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
