RESOLUTION NO. 95-136
A RESOLUTION SETTING FORTH AN EVALUATION OF A REQUEST FOR A RESCISSION
OF P&ZC RESOLUTION NO. 88-192 wmCH APPROVED THE PRELIMINARY SUBDIVISION
PLAN FOR DEVON HEIGHTS, TRACT 4079, BEING THAT PORTION OF THE SWv.. OF THE
NEv.. OF SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH
MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the MOHA VE COUNTY BOARD OF SUPERVISORS held
on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a
Rescission of a Resolution for a Preliminary Subdivision Plan, and
WHEREAS, the resolution which approved this subdivision indicates the developer of this tract is
Parnics Enterprises, Inc. of Bullhead City, Arizona, with G. Michael Reagan indicated as the representative.
The engineer of record is noted as Stovall Engineering Inc., Bullhead City, Arizona, and
WHEREAS, the subdivision is located south of the Bullhead City limits, east of Highway 95 and
north of Valencia Road, and
WHEREAS, the Preliminary Plan depicted approximately 25 acres subdivided into 74 single-family
lots, and
WHEREAS, the Preliminary Plan for this tract was approved by the MOHA VB COUNTY BOARD
OF SUPERVISORS on December 5,1988, per P&ZC Resolution No. 88-192. The first Extension of Time
was granted on December 3, 1990, per BOS Resolution No. 90-364 with a second extension granted on
December 2,1991, per BOS Resolution No. 91-314. This resolution granted an Extension of Time to
December 5, 1992. Since that time, no extensions have been requested by the owner of the property to bring
the subdivision to a current status. The zoning for the subdivision was approved per P&ZC Resolution No.
88-193, and
WHEREAS, a letter was sent by the Planning and Zoning Department in November of 1994
requesting that Extension of Time documentation and fees be submitted. Staff has received no comments
from the owner or developer regarding the Extension of Time, and
WHEREAS, staff is requesting that this resolution be rescinded because no action has been taken
to move the subdivision forward, and the Extension of Time expired over two years ago. This plan also has
ramifications on the development of adjacent properties. The proposed subdivision on the eastern boundary
of this site, known as Sage Creek Estates, has been designed on the basis that this subdivision will not be
completed. If this subdivision approval is rescinded, then the adjacent developer will be able to proceed
with their current design. If the rescission is not approved, minor changes may be necessary in regards to
the Sage Creek Estates plan, and

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 8, 1995, the Commission recommended APPROVAL for a rescission of a Preliminary Plan subject
to the following:
I. That P&ZC Resolution Nos. 88-192, 88-193 and BOS Resolution Nos. 90-364,92-314 be
rescinded.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County Arizona, March 19, 1994, and posted March 17, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 3, 1995, APPROVED this rescission as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
