RESOLUTION NO. 95-131
A RESOLUTION SETTING FORTH A REZONE OF BERMUDA PLANTATIONS, THE NY, OF
LOT 52, IN SECTION 15, TOWNSmp 17 NORTH, RANGE 22 WEST, FROM R-E
(RESIDENTIAL-RECREATION) ZONE TO R-l (SINGLE-FAMILY RESIDENTIAL) ZONE, IN
THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 3,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property to 1. Drew Lively and 1. Paul Lively ofMohave Valley, Arizona, and
WHEREAS, the applicants are requesting this zone change to allow the north half of Lot 52 which
lies between Dike Road, a private road, and Levee Drive to be divided into two parcels so as to allow two
residences on this property. The site is located between Levee Drive and Dike Road and east of Harbor
Avenue. It is accessed via Highway 95 and Harbor Avenue, then east on Dike Road to the site. The site is
on the north side of Dike Road and can be accessed from both Dike Road and Levee Drive, and
WHEREAS, the property is vacant at this time. The surrounding land uses consists of a few
scattered residential dwellings along the river and on the north side of Levee Drive and the remainder of the
lots in the area is vacant, and
WHEREAS, review ofFEMA FIRM Panel #040058-2615C indicates this parcel to be in Zone A,
in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is required for any development, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The two lots will be rezoned R-1/8M (Single-Family ResidentiallEight Thousand Square
Feet Minimum Lot Size).
2. The submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulation and 102.04-B of the Standard Specification is
required to show location of each parcel.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained.
4. The rezone shall not become effective until 30 days after final approval of the change in
classification by the Board of Supervisors, as per ARS 11-829E.

WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, March 19, 1995, and posted March 17, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 3, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
