MUHAVE COUNTY RECORDER' O~/05/9~ 1'15 p.r;, PAGE 1 Of 2 MOHAVE COUNTY BOARD OF SUPERVISORS RrCORDI~G FEE 0.00 HC RESOLUTION NO. 95-129 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR PALM ESTATES II, TRACT 4104, AND AN EXTENSION OF TIME FOR THE ABANDONMENT OF ROADWAYS AND EASEMENTS AND THE ABANDONMENT-REVERSION TO ACREAGE FOR PORTIONS OF RIO HACIENDAS, TRACT 1224, BEING A PORTION OF SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the MOHA VE COUNTY BOARD OF SUPERVISORS held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to G. Kelly Grier Stovall Engineers Inc., representing FBL, Ltd. Employees Defined Contribution Fund, Bullhead City, Arizona, for the above described Preliminary Subdivision Plan. The engineer of record for the subdivision is Stovall Engineers Inc., Bullhead City, Arizona, and WHEREAS, the subdivision is located east of Highway 95 and north of Camp Mohave Road, and WHEREAS, the Preliminary Plan depicts approximately 27 acres subdivided into 82 single-family lots. The first phase of this development has been recorded and improvements completed. Phase A of the development was recorded on June II, 1993, and WHEREAS, in a letter dated February 3, 1995, from G. Kelly Grier of Stovall Engineers, Inc. speaking on behalf of the owner of Palm Estates II, Tract 4104 indicates: "The previous owner/developer has defaulted on this property. The project is now proceeding with the aforementioned pension fund, the former financier, as the current owner of record. Stovall Engineers, Inc. has a contract with the trustee of the pension fund for Phase "B" of this development. Submittal to the County is anticipated within the neJ\:t two weeks. Phase "A" is already recorded and built out.", and WHEREAS, the Preliminary Plan for this tract was approved by the MOHA VE COUNTY BOARD OF SUPERVISORS on April 2, 1990, per BOS Resolution No. 90-80. The first Extension of Time was granted on Novernber 4,1991, per BOS Resolution No. 91-292, the second Extension of Time was granted on April 2, 1992, per BOS Resolution No 92-108, the third Extension of Time was granted on April 5, 1993. per BOS Resolution No. 93-83, and the fourth Extension of Time was granted on May 2, 1994, per BaS Resolution No. 94-133. Article 3.10-1 states, "Upon application to the commission and prior to the expiration, of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated.", and ,~ . . RESOLUTION NO. 95-129 Page 2 WHEREAS, the abandonments for roadways and easements was approved via Resolution No. 90- 313 on November 5, 1990. The abandonment/reversion to acreage was approved via Resolution No. 90-312 on November 5, 1990. A condition of approval for the abandonments was that the Final Plat for Palm Estates II, Tract 4104-A, be recorded within one year or the abandoned portions would revert to their previous designation, and WHEREAS, this will be the fifth Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for an Extension of Time for a Preliminary Plan subject to the following: 1. Compliance with all conditions ofBOS Resolution Nos. 90-80, 90-312, 909-313, 92-108, 93-83,94-133. 2. This Extension of Time will be in effect until April 2, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County Arizona, March 19, 1994, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning as Zoning Commission and outlined herein.
