RESOLUTION NO. 95-128 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR THE COVES AT RIVER TERRACE, TRACT 4139, BEING A PORTION SECTIONS 22 AND 23, TOWNSIDP 17 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the MOHA VE COUNTY BOARD OF SUPERVISORS held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described Preliminary Subdivision Plan for Coves at River Front Terrace, Tract 4139. The owner/developer of this tract is Frank Curcio, Mohave Valley, Arizona, and the engineer of record is Gilbertson Associates Inc, and WHEREAS, the subdivision is located adjacent to the Colorado River, east of Highway 95IHarbor Avenue, and south of Courtwright Road. The Preliminary Plan depicts approximately 186 acres subdivided into 586 single-family lots, and WHEREAS, the letter requesting the Extension of Time was submitted prior to the new policy regarding extensions was approved; however, the fees required for the extension were not received until the extension policy was approved, and WHEREAS, the owner stated in a letter dated December 28, 1994, that he is in escrow with a [mancial group willing to fund the project, upon obtaining verification that the extension for the Preliminary Plan is approved. The letter also states anticipation of actual construction to begin in early spring of 1995, and WHEREAS, the Preliminary Plan for this tract was approved by the MOHA VE COUNTY BOARD OF SUPERVISORS on March 9, 1992, per BOS Resolution No. 92-63. The first Extension of Time was required in March of 1994. An extension was not applied for at that time. The owner has submitted fees to bring the subdivision to current status and extend the Preliminary Plan for an additional year. Article 3.10-1 states, "Upon application to the commission and prior to the expiration, of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated.", and WHEREAS, this will be the second Extension of Time, and WHEREAS, based on the new policy regarding Extensions of Time, staff feels that this request does not meet the requirements set forth in the Extension of Time policy. No Final Plan has been submitted for approval and no phases of the subdivision have been recorded, and RESOLUTION NO. 95-128 Page 2 .. . . WHEREAS, additional information was submitted to the Commission showing that the owner is actively processing the recordation of the subdivision. Staff originally recommended denial of the extension however, it was noted at the meeting that staff did not have a problem with the Commission recommending approval of this extension because of the additional information submitted, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for an Extension of Time for a Preliminary Plan subject to the following: 1. Compliance with all conditions ofBOS Resolution Nos. 92-63. 2. This Extension of Time will be in effect until March 9, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County Arizona, March 19, 1994, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April3, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning as Zoning Commission and outlined herein.
