PAGE " OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECOROI~~ FEE 0.00 HC RESOLUTION NO. 95-127 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR THE COLORADO RIVERFRONT TERRACE, PHASE II, TRACT 4135, BEING A PORTION SECTION 23, TOWNSHIP 17 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA,MOHA VE COUNTY,ARIZONA. WHEREAS, at the regular meeting of the MOHA VE COUNTY BOARD OF SUPERVISORS held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described Preliminary Subdivision Plan of Colorado Riverfront Terrace, Tract 4135. The owner/developer of this tract is Frank Curcio, Mohave Valley, Arizona. The engineer of record is Mohave Engineering Associates Inc., Kingman Arizona, and WHEREAS, the subdivision is located adjacent to the Colorado River, east of Highway 95IHarbor Avenue, and south of Riverfront Parkway. The Preliminary Plan depicts approximately four and one-half acres subdivided into 22 single family lots, and WHEREAS, this phase is adjacent to Colorado Riverfront Terrace, Tract 4082. Both Phases have been created by the same owner and will use the same entry way. Even though Phase II has a different tract number, it is an extension ofthe recorded Phase I, and WHEREAS, the letter requesting the Extension of Time was submitted prior to the new policy regarding extensions was approved; however, the fees required for the extension were not received until after the extension policy was approved, and WHEREAS, the Preliminary Plan for this tract was approved by the MOHA VE COUNTY BOARD OF SUPERVISORS on July 22, 1991, per BOS Resolution No. 91-194. A Revised Preliminary Plan for this tract was approved by the MOHA VE COUNTY BOARD OF SUPERVISORS on March 9,1992, per BOS Resolution No. 92-64. The first Extension of Time was required in March of 1994. An extension was not applied for at that time. The owner has submitted fees to bring the subdivision to current status and extend the Preliminary Plan for an additional year. Article 3.1 0-1 states, "Upon application to the commission and prior to the expiration, of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated.", and WHEREAS, this will be the second Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for an Extension of Time for a Preliminary Plan subject to the following: RESOLUTION NO. 95-127 Page 2 f! . . . . 1. Compliance with all conditions ofBOS Resolution Nos. 91-194 and 92-64. 2. This Extension of Time will be in effect until March 9, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County Arizona, March 19, 1994, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning as Zoning Commission and outlined herein.
