PAGE 1 GF 2 MOHAVE COUNTY BOARD Of SUPERVISORS RFCGRO!r,ij FEE 0.00 N(' RESOLUTION NO. 95-125 A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT IN VIRGIN ACRES TRACT NO. 1, BLOCK 160, LOTS 1,2,7 AND 8 IN THE NY., NEYo OF SECTION 32, TOWNSHIP 41 NORTH, RANGE 15 WEST, FOR A WASTE-WATER TREATMENT PLANT IN A M (GENERAL MANUFACTURING) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting ofthe Mohave County Board of Supervisors held on April 3, 1995, a public hearing was conducted to determine whether approval should be granted for a Specific Use Permit for a waste-water treatment plant for the above described property to the Biasi Ranch Partnership, Mesquite, Nevada. The developer of the site proposes a waste-water disposal plant that is to be used for the Virgin Acres, Tract No.1, Blocks 129 through 136 and Blocks 153 through 160 subdivision, and WHEREAS, the applicant proposes to develop the property for single-family residences. This site is for the waste-water treatment plant to support the subdivision. The site is located west of U.S. Highway 91 and north of the Interstate 15 and Highway 91 interchange in the Littlefield area. The site is accessed from Highway 91 via west on McKnight Road and an ingress and egress easement (I&E), north on Arizona Avenue to the site. The site is on the west side of Arizona Avenue, in the southeast corner of Block 160, and WHEREAS, the surrounding land uses consist of the Virgin Village No.2 subdivision to the south. Beaver Dam Oasis, Tract 3502 is to the southeast. The proposed Virgin Mountain Estates Mobile Home Park and the proposed Beaver Dam Heights, Tract 3503 are to the east. The property to the north and west is part of the Virgin Acres, Tract No.1 subdivision and is vacant, and WHEREAS, review ofFEMA FIRM Panel #040058-0025B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 8, 1995, the Commission recommended APPROVAL for a Specific Use Permit subject to the following: I. This Specific Use Permit is for the Virgin Acres, Tract No.1, Block 160, Lots I, 2, 7 and 8 and is only for the waste-water treatment plant and activities related thereto; any new use will require another Specific Use Permit. 2. The applicant will provide a six-foot view-obscuring fence around this property and the waste water treatment plant will be enclosed within a building. 3. The Specific Use Permit will commence upon the effective date ofthe rezone. RESOLUTION NO. 95-125 Page 2 . " . . 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained. 6. Approval of a Specific Use Permit with such conditions and restrictions as the Board of Supervisors may impose, shall be valid for two (2) years, in which time construction on the project shall commence or the use authorized shall be initiated. Prior to expiration of the approval, the developer may request an Extension of Time from the Commission to initiate the project, and the Commission shall recommend to the Board an action based upon a finding of substantial grounds of which to grant such an Extension of Time up to one (1) year. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 19,1995, and posted March 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 3, 1995, APPROVED this Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
