RESOLUTION NO. 95-104
A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT FOR AN ELECTRICAL POWER
CO-GENERATING PLANT FOR SCOTT PAPER COMPANY AND NORDIC POWER L. L. C.,
IN A M-X (REA VY MANUFACTURING) ZONE ON 30 ACRES LOCATED IN A PORTION OF
THE W 112, SW 1/4 OF SECTION 13, TOWNSHIP 17 NORTH, RANGE 18 WEST, IN THE
YUCCA PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10,
1995, a public hearing was conducted to determine whether approval should be granted for a Specific Use
Permit for the above described property to Scott Paper Co. and Nordic Power L.L.C., being represented by
the Mohave County Economic Development Authority Inc., Kingman, Arizona, and
WHEREAS, the property is located west of Interstate 40, south of the township of Yucca, and is
accessed from 1-40 via the west interchange to the Scott Paper site, and
WHEREAS, the site is relatively flat, sloping to the southwest, and is vacant. The surrounding land
is vacant and Scott Paper is to the north, and
WHEREAS, the power plant is a peaking plant and will operate only when local demand for
electricity is greater than available along line supplies. The power plant will be co-generated, capable of
producing steam and heat for Scott Paper Company's future expansion, and
WHEREAS, review ofFEMA FIRM Panel #040058-2675B indicates this parcel to be in Zone C,
not in a FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 8, 1995, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:
1. That the Specific Use permit will be only for the co-generation power plant and activities
related thereto; any new use will require an additional Specific Use Permit.
2. The applicant comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.

3. The appropriate zoning, building, environmental and floodplain permits be obtained.
4. Approval of a Specific Use Permit with such conditions and restrictions as the Board of
Supervisors may impose shall be valid for four years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project and the Commission shall recommend to the Board an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one year.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted February 17, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Friday, March 10, 1995, APPROVED this Specific Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
