RESOLUTION NO. 95-102 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 7A, STOCKTON fiLL RANCHES, UNIT XII, SECTION 5, TOWNSHIP 23 NORTH, RANGE 16 WEST, FOR THE ESTABLISHMENT OF A DOG KENNEL IN AN A-R/I0A (AGRICULTURAL-RESIDENTIAL/ TEN ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1995, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to Parnelia R. McConnell Lagerwey of Kingman, Arizona, and WHEREAS, Ms. Lagerwey is requesting this Zoning Use Permit for a kennel because she owns more than four dogs. Mohave County Zoning Regulations allow only four dogs; five or more dogs require a permit for a kennel, and WHEREAS, the property is located east of Stockton Hill Road and north of Calle Lucero Road. It is accessed from Stockton Hill Road, east on Calle Lucero Road to Dubois Drive, then north on Dubois Drive to North Yeater Road, then west on North Yeater Road to the site. The property is located on the south side of North Yeater Road, and WHEREAS, the site is relatively flat and the surrounding land uses consist of vacant land. This parcel was created when Parcel 7 was rezoned via BaS Resolution No. 94-396 creating two ten-acre parcels (7-A and 7-B) on the east side of Parcel 7, and WHEREAS, review ofFEMA FIRM Panel #040058-0200B indicates this parcel to be in Zone C, not in a FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 8, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. The dog kennels and dog runs will not be constructed within 100 feet of the property lines. 2. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 19, 1995, and posted February 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, March 10,1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
