PAGE 1 OF 2 KOHAVE CO~~TY 80ARD OF SUPERVISORS ~ECORDING FEE 0,00 He MICROALMED RESOLUTION NO. 95-197 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 25-2, MOUNTAIN VISTA RANCHES, PHASE II, AS SHOWN BY BOOK 9, PAGE 14B OF PARCEL PLATS, IN SECTION 25, TOWNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRlCULTURAL- RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A AND A-R/15A (AGRlCULTURAL-RESIDENTIAL/FIVE ACRE AND FIFTEEN ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Richard and Sharon Rose of Beaverton, Oregon, and WHEREAS, the property is located south of Huntington Avenue and west of Benjamin Road. This land is accessed via Highway 66, then northwest on Antares Road, then west on Huntington A venue, then south on Benjamin Road, then west on Brooks Boulevard to the site, and WHEREAS, the site is vacant and flat. There are no residences or developments in the area. The owner proposes to split the 37.9 acre parcel into four five-acre parcels and a 15-acre parcel. There are several splits in the area of similar acreage, and WHEREAS, there are not any significant washes or drainage that cross the property. Review of FEMA FIRM Panel # 040058-2025B indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The four northern parcels will be rezoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) and the southern parcel will be rezoned A-R/15A (Agricultural- Residential/Fifteen Acre Minimum Lot Size). 2. The submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and l02.04-B of the Standard Specifications is required. 3. That the Board of Supervisors accepts the dedication of a 30-foot roadway along the west boundary of the five-acre parcels known as Jenning Road and a 30-foot roadway along the east boundary of Parcel 25-2 which shall be known as Gracie Road and a 50-foot roadway between the l5-acre parcel and the five-acre parcels which shall be known as Pauline Drive and the road names shall be shown on the parcel plat. In addition, 20-foot radius curves are required at all dedicated roadway intersections. RESOLUTION NO. 95-197 Page 2 . . PAGE 2 OF 2 BK 2562 PG 854 (F~E;95-23061) 4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to the roadways. 5. The grantings and dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That the appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until parcel plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If the conditions stated above are not completed and approved within one year, then this rezone shall become void as follows: the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 1, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
