RESOLUTION NO. 95-196 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 46, PEACOCK MOUNTAIN RANCHES, AS SHOWN BY BOOK 1, PAGES S5-S5C OF PARCEL PLATS, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 15 WEST, FROM A-R/I0A (AGRlCULTURAL- RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRlCULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by William and Joan Sayles of Borrego Springs, California, and WHEREAS, the property is located east of Roundup Avenue and north of Siesta Drive. This land is accessed via Highway 40, at the D.W. Ranch Road exit, then east on the highway frontage road, then northwest on Roundup Avenue, then east on Siesta Drive to the site, and WHEREAS, the site is vacant and mostly flat to slightly rolling. There are scattered residences to the east and west. Power lines run northwest by southeast on the west side Roundup Avenue, and WHEREAS, the owner proposes to split the 38 acres into four five-acre parcels with a remainder parcel of 18 acres. There are several splits in the area that are of similar acreage. The Mohave County General Plan designates this area as rural which provides for five-acre minimum lot sizes, and WHEREAS, there are not any significant drainage or washes that cross the property. Review of FEMA FIRM Panel # 040058-2350C indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The southern four parcels will be rezoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) and the northern half of Parcel 46 will remain A-R/I OA (Agricultural- Residential/Ten Acre Minimum Lot Size). 2. The submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications is required. " ,. . That the Board of Supervisors accepts the dedication of a 20-foot radius curve at the intersection point of Amarillo Drive and Siesta Road. 4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to the dedicated roadway and following the radius curve. 5. The grantings and dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access, 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That the appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until parcel plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If the conditions stated above are not completed and approved within one year, then this rezone shall become void as follows: the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May I, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
