RESOLUTION NO. 95-195 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 29-4, MUSIC MOUNTAIN RANCHES, AS SHOWN BY BOOK 5, PAGES 45-45F OF PARCEL PLATS, IN SECTION 29, TOWNSHIP 24 NORTH, RANGE 14 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/I0A (AGRICULTURAL-RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Thomas and Connie Kidd of Ogden, Utah, and WHEREAS, the property is located south of Huntington Drive and west of Bach Road. This land is accessed via Highway 66, then northwest on Antares Road, then east on Huntington Drive to the site, and WHEREAS, the site is flat and vacant. There are a few residences to the south but no other residences or development in the area. Power lines run north to south on the east side of Bach Road. The owner proposes to split the 37.9 acres into three parcels; two parcels containing ten-plus acres and one parcel containing 17 -plus acres. There are several splits in the area that are of similar acreage, and WHEREAS, there are not any significant drainage or washes that cross the property. Review of FEMA FIRM Panel # 040058-2025B indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R/lOA (Agricultural-Residential/Ten Acre Minimum Lot Size). 2. The submittal and recordation of a parcel plat prepared in accordance "With Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications is required. 3. That the Board of Supervisors accepts the dedication of a 20-foot radius curve at the intersection point of Bach Road and Huntington Ave. 4. The dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. ... . . . MOHA VE COUNTY BOARD OF SUPERVISORS 7. The parcel plat shall show any surface drainage and FEMA flood zones. 8. That the appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until parcel plat recordation. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 10. If the conditions stated above are not completed and approved within one year, then this rezone shall become void as follows: the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May I, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
