RESOLUTION NO. 95-189 A RESOLUTION SETTING FORTH A REZONE OF THE EYz SE'/.i SW'/.i SE'/.i OF SECTION 2, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRIcULTURAL- RESIDENTIALrfEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/IA (AGRIcUL TURAL- RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 1, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Merrill Graham of Golden Valley, Arizona, and WHEREAS, the property is located north of Chino Drive and west of Houck Road. This land is accessed via Highway 68, then north on Houck Road to the site, and WHEREAS, the site is mostly flat with one residence, with scattered residences in the area. Power lines run north to south on the west side of Houck Road. The owner proposes to split the five acres into four one-acre-plus parcels. Frontage for these parcels will be from Houck Road. There are several one-acre parcels in the area, and WHEREAS, there are not any significant drainage or washes that cross the property. Review of FEMA FIRM Panel # 040058-2325B indicates that this parcel is within Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conmlission on April 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. These parcels will be rezoned A-R/IA (Agricultural-Residential/One Acre Minimum Lot Size). 2. The submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications is required. 3. That the Board of Supervisors accepts the dedication of a 50-foot roadway on the eastern boundary known as Houck Road and a 50-foot roadway on the southern boundary known as Chino Road. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. That the Board of Supervisors accepts the granting of an eight-foot PUE adjacent to the dedications. -" \.o.~ . . RESOLUTION NO. 95-189 Page 2 PAGE 2 OF 2 BK 2562 PG 835 (FEE~95-23053) 5. The grantings and dedications required by the rezone resolution shall be shown on the parcel plat and accepted by the Board upon parcel plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The parcel plat shall show any surface drainage and FEMA flood zones. 9. That the appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until parcel plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If the conditions stated above are not completed and approved within one year, then this rezone shall become void as follows: the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 1, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
