PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC ".... :) MICROFILMED RESOLUTION NO. 95-177 A RESOLUTION SETTING FORTH A ZONING USE PERMIT FOR AN ELECTRICAL SUBSTATION IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE FOR MOHA VE ELECTRIC COOPERATIVE, INC., LOCATED IN A PORTION OF THE SEY-i NEY-i OF SECTION 24, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property as requested by Mohave Electric Cooperative, Inc., (MEC) represented by David J. Bryan, P.E., of Bullhead City, Arizona, and WHEREAS, MEC is requesting this Zoning Use Permit for an electric substation in the South Mohave Valley Area to serve the present and future residents and businesses that reside near Fort Mohave Mesa. In addition, this substation will provide electrical service as far away as Willow Valley or Riverview Drive as needed, and WHEREAS, the site is located east of Highway 95 and west of Vanderslice Road between Camp Mohave and El Rodeo Roads and is their second choice of a location after the location on Camp Mohave Road was denied by the Commission. It is accessed from Highway 95 via Camp Mohave Road to Vanderslice Road, then south on Vanderslice Road to the site. The property is located south of Camp Mohave Road in the southeast corner of the northeast quarter of Section 24, and WHEREAS, the site is relatively flat, vacant and slightly sloping to the west. The surrounding land is vacant, and WHEREAS, a public utility facility is allowed in any zone with a Zoning Use Permit as stated in the provisions of the Mohave County Zoning Regulations, Section 27-A, General Provision, Special Uses. The use must be deemed essential or desirable to the public convenience or welfare, and WHEREAS, review ofFEMA FIRM Panel #040058-2435D indicates this parcel to be in Zone AO, in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is required for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: ( . . RESOLUTION NO. 95-177 Page 2 PAGE 2 OF 2 BK 2562 PG 811 (FEEt95-23041) 1. The applicant will provide a view-obscuring fence around the property. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The applicant shall procure all the necessary state permits and leases for this project.. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 1,1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
